City of Rahway, NJ Article II Defined Contribution Retirement Program

§ 73-20 Participation required for eligible employees.

Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program, unless otherwise permitted to participate in the Public Employees' Retirement System (PERS) in accordance with the terms of P.L. 2007, c. 92:

A. City Business Administrator;

B. Department Directors;

C. Municipal Court Judge;

D. Director of Law;

E. Commissioners of the Rahway Housing Authority;

F. Commissioners of the Rahway Parking Utility;

G. Commissioners of the Rahway Redevelopment Agency;

H. Executive Director of the Rahway Redevelopment Agency.

§ 73-21 Exempt positions.

Individuals serving in the following positions are exempt from Defined Contribution Retirement Program membership, pursuant to N.J.S.A. 43:15C-2:

A. Certified Health Officer;

B. Tax Collector;

C. Chief Financial Officer;

D. Construction Code Official;

E. Qualified Purchasing Agent;

F. Tax Assessor;

G. City Planner;

H. Registered Municipal Clerk;

I. Licensed Uniform Subcode Inspector;

J. Principal Public Works Manager.

§ 73-22 Legislative authority.

This article shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq. and N.J.S.A. 43:15A-7.2), as amended from time to time, and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.

§ 73-22.1 Filing of provisions.

A copy of this article shall be filed with the Director of the Division of Pensions and Benefits of the New Jersey Department of the Treasury.
