Unless otherwise expressly stated, the following terms shall, for the purpose of this Chapter 152, have the meanings herein indicated. Terms not defined in this article shall have the meanings set forth in 6 NYCRR § 360-1.2, as the same may be amended from time to time. To the extent that any definition(s) contained in this chapter varies from the definition(s) contained in 6 NYCRR § 360-1.2, as the same may be amended from time to time, the definition(s) contained in 6 NYCRR § 360-1.2 will control.
A person who operates or causes to be operated in the Town
any vehicle for the collection of solid waste.
"Solid waste management facility" as defined in 6 NYCRR § 360-1.2(b),
as the same may be amended from time to time.
Garbage and refuse, as defined herein, and all other waste
material which, if thrown or deposited as herein prohibited, tends
to create a danger to public health, safety and welfare.
Measures, processes, methods, systems or techniques that
have been demonstrated to achieve the lowest emissions of odors and
air and liquid pollutants through procedures including enclosing processes
or systems to eliminate emissions by collecting, capturing or treating
pollutants before release from a process, stack, storage or fugitive
emissions point.
Radioactive materials which are source, special nuclear or
by-product material as defined by the Atomic Energy Act of 1954.
Is defined in § 1389-aa of the New York Public
Health Law, as the same may be amended from time to time.
The Town of Wawayanda.
The Town Board of the Town of Wawayanda, which is the legislative
body of the Town.
The Planning Board of the Town of Wawayanda.
The local law, or laws, adopted by the Town Board which set forth the zoning regulations of the Town of Wawayanda, as the same may be amended from time to time, which are codified in Chapter 195 of the Town Code.
