There shall be a Town Clerk who shall be elected at each General Election for a term of two years and shall serve until a successor is elected and qualified.
The Town Clerk shall not hold any other Town office or any paid public employment in any position of the Town, except as otherwise provided by the Charter. Nor shall the Town Clerk be employed by the Town in any position, other than as an elected office holder or in the School Department, for a period of one year after the completion of his/her term.
There shall also be a Deputy Town Clerk appointed by the Town Clerk with the approval of the Council. When the Town Clerk is not available, the Deputy shall perform all the duties which are granted to the Office of the Town Clerk and perform such other duties as may be required.

The Town Clerk shall be the Clerk of the Financial Town Referendum, Clerk of the Council, Clerk of the Probate Court, Clerk of the Board of Canvassers, and the Recorder of Deeds. It shall be the duty of the Town Clerk to:
(1) 
Make a permanent record of all proceedings and certify by signature all actions of the aforesaid bodies;
(2) 
Be custodian of the Town Seal and of the official documents and records of the Town;
(3) 
Direct, supervise, and be responsible for the recording of deeds, mortgages, vital statistics, licenses and permits and such other records as shall by Ordinance and Law be required to be kept by the Town Clerk;
(4) 
Issue marriage licenses, burial permits, and such other licenses and permits as are required by Ordinance and Law to be issued by the Town Clerk;
(5) 
Perform such other duties as may be prescribed by this Charter or by Law pertaining to Town Clerks, and such other duties appropriate to the Office as the Council may require.

The Town Clerk and Deputy Town Clerk shall receive such annual salaries as included in the budget approved by the electors at the Financial Town Referendum. All fees collected by either the Town Clerk or Deputy Town Clerk shall be transmitted to the Town Treasurer and deposited in the general funds of the Town unless otherwise directed by the laws of the State.
