A certain document, three copies of which are on file in the office of the Manager/Secretary of the Borough of Marcus Hook, Delaware County, Pennsylvania, being marked and designated as the "BOCA National Fire Prevention Code, Ninth Edition, 1993," as published by the Building Officials and Code Administrators International, Inc., be and hereby is adopted as the Fire Prevention Code of the Borough of Marcus Hook in the Commonwealth of Pennsylvania for the control of buildings, structures and premises as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Fire Prevention Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 96-3 of this chapter.
By this chapter, Chapter 96, entitled "Fire Prevention," of the Codified Ordinances of the Borough of Marcus Hook, Pennsylvania, 1990, as supplemented and amended, and all other ordinances or parts of ordinances in conflict herewith are hereby repealed.[1]

The following sections are hereby revised as follows:
A. 
In Section F-101.1 insert "Borough of Marcus Hook."
B. 
Whenever the word "municipality" is used in this code, it shall be held to mean the Borough of Marcus Hook.
C. 
Whenever the words "Fire Official" are used in this code, they shall be held to mean the Fire Chief and/or the Assistant Fire Chief.
D. 
In Section F-107.2, Permits required, delete "permit fees, if any, shall also be stipulated in the local adopting legislation" and replace with "permit fees, if any, will be calculated using the fee schedule adopted by resolution by the Council of the Borough of Marcus Hook."
E. 
In Section F-113.1, Application for appeal, delete the first sentence and add: "Any person shall have the right to appeal a decision of the Fire Chief to the Council of the Borough of Marcus Hook." Delete the third sentence and add: "An application for a special hearing may be made in writing to the Manager/Secretary's office within 20 days of the time that the notice was served."
F. 
In Section F-113.2, Membership of Board, replace with: "For the purposes of this chapter, the word 'Board,' wherever it may appear in this code, will be defined as meaning the Council of the Borough of Marcus Hook."
G. 
Sections F-113.2.1 through F-113.2.6 are hereby deleted.
H. 
In Section F-113.5, Postponed hearing, change the words "When five members" to the words "When any four Council members."
I. 
In Section F-202.0, General Definitions, add the following definition for "Fire Lane": "The words 'fire lane' shall mean those aisles, roadways, passageways or other areas located on private property which are designated by the Fire Chief as fire lanes to ensure ingress and egress of fire or other emergency vehicles for the protection of persons and property and where such areas, when blocked or congested, would interfere with the free movement of such emergency vehicles."
J. 
In Section F-311.1, Fire lane designation, add the following after the last sentence: "The plans for fire lanes shall be submitted to and approved by the Fire Chief, and a permanent record of the establishment of said fire lanes shall be maintained by the Borough of Marcus Hook. The cost of marking and maintaining said fire lanes and plan of the same shall be borne by the owner of the property where said lanes are located. A fire lane shall be designated by a solid yellow line or lines and marked on the paved surface as a fire lane and by signs establishing such lanes which read NO PARKING FIRE LANE or similar wording."
K. 
In Section F-311.2 Fire lane obstructions, add the following sentence: "The parking of any vehicle or otherwise obstructing fire lanes shall be prohibited at all times."
The limits referred to in Section F-3003.2 of the BOCA National Fire Prevention Code/1993 in which the storage of explosive materials is prohibited are hereby established as follows: the boundaries of the Borough of Marcus Hook.
Nothing in this chapter or in the Fire Prevention Code hereby adopted shall be construed to affect any lawsuit or proceeding impending in any court or any rights acquired or liability incurred or any cause or causes of action acquired or existing under any act or ordinance hereby repealed as cited in § 96-2 of this chapter, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
A. 
Any person violating any of the provisions of this chapter shall, upon conviction thereof, be punishable for each offense by a fine of up to the maximum amount provided from time to time by state statute.
B. 
The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions.
