Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program (DCRP):
A. 
Business Administrator.
B. 
Constituent Relations Specialist.
C. 
Municipal Attorney.
D. 
Municipal Engineer.
E. 
Municipal Prosecutor.
F. 
Municipal Court Judge.
Individuals serving in the following positions are exempt from Defined Contribution Retirement Program membership, pursuant to N.J.S.A. 43:15C-2:
A. 
Tax Collector.
B. 
Chief Financial Officer.
C. 
Construction Code Official.
D. 
Qualified Purchasing Agent.
E. 
Tax Assessor.
F. 
Municipal Clerk.
G. 
Licensed Uniform Subcode Official.
H. 
Certified Public Works Manager.
I. 
Municipal Court Administrator.
In accordance with N.J.S.A. 43:15C-2, any elected official who was enrolled in the Public Employee Retirement System (PERS) prior to July 1, 2007, and who would otherwise be eligible for enrollment in the DCRP, will continue his or her enrollment in the PERS while that person continues to hold that elected office without any interruption in service. Any official elected to office on or after July 1, 2007, who was not previously enrolled in the PERS, is ineligible for enrollment in the PERS and may only be enrolled in the DCRP.
In accordance with N.J.S.A. 43:15C-2, any appointed official who was enrolled in the PERS prior to July 1, 2007 will remain enrolled in the PERS while serving in their appointed positions.
A. 
Any appointed official who was appointed on or after July 1, 2007, and who was not previously enrolled in the PERS prior to that appointment, may only be enrolled in the DCRP, and is not eligible for enrollment in the PERS.
B. 
Any regular employee enrolled in the PERS prior to July 1, 2007, who is appointed, without a break in PERS membership, to a DCRP-eligible position on or after July 1, 2007, will remain enrolled in the PERS while in their appointed position.
This article shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.) as amended from time to time, and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.
