GENERAL REFERENCES

The purpose of this chapter is to protect the safety and welfare of the citizens of Manchester Township by the imposition of mercantile license fees upon any person, firm, proprietorship, partnership, association or corporation doing business within the Township of Manchester, and to regulate those businesses for the general welfare of the public.
A. 
It shall be unlawful for any person, firm, proprietorship, partnership, association or corporation to maintain any office or place of business, trade or occupation within the Township without first complying with the provisions of this chapter and obtaining a license therefor as provided herein.
B. 
The requirements of this chapter shall not apply to any business, occupation or profession licensed under the laws of the State of New Jersey.
Application for all mercantile licenses as required in this chapter shall be made in writing to the Zoning Officer, who shall serve as the licensing officer. Each application shall contain the following information:
A. 
Name, address and social security number of applicant.
B. 
Name and address of the business, trade or occupation.
C. 
The business telephone number of the business, trade or corporation.
D. 
Nature of the business, trade or occupation.
E. 
Residence of the applicant for the five years preceding the date of application.
F. 
Details of any conviction of any crime, the nature of the offense, the date of the conviction and place of the conviction.
G. 
Registered agent, if any.

A. 
The annual fee for the mercantile license described in this chapter shall be:

(1) 
For buildings one to 2,500 square feet in size: $75.
(2) 
For buildings 2,501 to 10,000 square feet in size: $150.
(3) 
For buildings 10,001 to 100,000 square feet in size: $300.
(4) 
For buildings over 100,001 square feet in size: $750.
B. 
A license fee shall be paid in advance to the Township, due no later than January 31 of each year. The license shall be valid until December 31 of each year.
C. 
The license shall be renewed annually by submitting a renewal application along with the required fee.[1]

No license shall issue if the business, occupation or trade does not fully comply with the ordinance and laws of the Township of Manchester, or any state or federal law, rule or regulation.
The person, firm, proprietorship, partnership, association or corporation licensed hereunder shall display the license at the principal place of business in a conspicuous place. The license holder shall notify the Zoning Officer within 10 days after any change in location of the principal place of business, or any other change in the original application information.

The Township shall have the right to revoke any license issued hereunder whenever the license holder or his agent shall violate any provision of this chapter or any of the ordinances or laws of the Township or any law, rule or regulation of the State of New Jersey or the federal government. After written notice of the revocation has been served upon the licensee, an appeal may be filed with the Township Council within 10 days of the service of the written notice of revocation. The Council, upon notice to the license holder with an opportunity to be heard, shall conduct a hearing within 30 days of the receipt of the notice of appeal and render a decision within 15 days after the close of the hearing.

Any person, firm, proprietorship, partnership, association or corporation who violates any provision of this chapter, or whose agents violate any provision of this chapter, shall, upon conviction, be liable to the penalty stated in Chapter 1, Article II, General Penalty.
