A. 
There is hereby established in the Town of Colonie, Albany County, New York, a department to be designated the "General Services Department" for administration of the Town's purchasing operations and custodial operations and such additional functions as may be assigned by the Town Supervisor. The groundskeeping, building and facilities maintenance and repair operations of the General Services Department are hereby transferred to the Department of Public Works, Division of Facilities Maintenance, of the Town of Colonie under the supervision of the Commissioner of Public Works or his designee. All maintenance and repair and grounds personnel assigned to the General Services Department are now transferred to the Division of Facilities Maintenance of the Department of Public Works. Employee titles shall be modified accordingly.

B. 
The General Services Department shall be headed by an official designated as the "Director."
The General Services Director shall be appointed by the Supervisor with the consent of the Town Board at a compensation to be fixed by the Town Board.
In the absence of the General Services Director or in the case of his inability to act for any reason, the Supervisor shall have the power, with the consent of the Town Board, to designate a person to act in his behalf and to exercise all of the powers conferred upon him by this chapter.
No officer or employee at the General Services Department shall engage in any activity inconsistent with his duties or with the interests of the General Services Department.
No official or employee of the General Services Department shall, while acting pursuant to the provisions of this chapter, be personally liable for any damage that may accrue to persons or property as the result of any act required or permitted in the discharge of his official duties, provided that such acts are performed in good faith and without gross negligence.

Except as otherwise specifically provided by law, ordinance or regulation or except as herein otherwise provided, the General Services Director is responsible for the supervision of the Town's General Services Department. Those responsibilities include the administration and management of all purchasing functions of whatever kind for each and every Town department, board or agency for which the Town may in any event be liable and for any special district in the Town, in accordance with § 41-b of the Town Law, other applicable law and such regulations, policies or procedures as may establish uniform purchasing practices for the Town; standardize supply, material and equipment needs therefor; and conduct of the sale or lease of any surplus, excess or obsolete property in accordance with any regulations, policies or procedures established by the Town Board. The General Services Director shall also prepare, review and examine all specifications relative to competitive bidding or procurement pursuant to the General Municipal Law, other applicable law and regulations and perform such additional functions as may be assigned by the Town Supervisor. The General Services Director shall also be responsible for all custodial operations of whatever kind for each and every Town building and facility.

The General Services Director shall keep permanent official records of all transactions and activities of the General Services Department for such periods as required by law. All such records shall be public records open to public inspection during business hours, as permitted by applicable laws, rules and regulations.
B. 
The General Services Director shall, annually, submit to the Town Board a written report and summary of all business conducted by the General Services Department.

The General Services Director may request and shall receive, so far as may be necessary in the discharge of his duties, the assistance and cooperation of all other municipal offices exercising any jurisdiction over purchasing and custodial operations or such other areas assigned to the General Services Director by the Town Supervisor.
