For the purpose of promoting the safety, health and general
welfare of the residents and owners of property in the Town of Amherst,
no person, firm, association or corporation shall erect, construct,
install, maintain or provide cable television service within the Town
of Amherst unless a permit or franchise so to do shall first have
been granted by the Town Board of said Town as hereinafter provided.
Any and all applications for such permit or franchise shall
be subject to a public hearing conducted after notice published once
in the official newspaper of said Town not less than 10 days nor more
than 20 days prior to the public hearing thereon.
Any person, firm, association or corporation violating the provisions
of this chapter as hereinbefore stated shall be subject to a penalty
of $100 for each and every day that such violation continues.
This chapter shall take effect 10 days after its adoption and
publication as provided by law.
