§ 70-1 Plenary retail consumption license.

Subject to the provisions of N.J.S.A. 33:1-12(1), the holder of a plenary retail consumption license shall be entitled to sell any alcoholic beverages for consumption on the licensed premises by the glass or other open receptacle and also to sell any alcoholic beverages in original containers for consumption off the licensed premises.

§ 70-2 Application for license.

All applications for licenses shall be in writing, shall conform to the official form promulgated by the Director of the Division of Alcoholic Beverage Control and shall be filed with the Township Clerk with evidence of payment of the federal tax stamp and the annual license fee as hereinafter provided. The applications shall be addressed to the Township Committee. All questions shall be fully answered, and the application shall be made under oath and shall designate the place and type of license applied for.

§ 70-3 Duration of license.

All licenses shall be issued for a term of one year, beginning on July 1 of the year of issuance and expiring on June 30 of the following year.

§ 70-4 License fee.

The annual fee for a plenary retail consumption license or plenary retail distribution license shall be $330.

§ 70-5 Hours of sale.

A. 
No licensee shall sell, serve or deliver, or allow, permit or suffer the sale, service or delivery of, any alcoholic beverage on licensed premises on New Year's Day, when it is a weekday, between the hours of 5:00 a.m. and 7:00 a.m.; on New Year's Day, when it is a Sunday, between the hours of 5:00 a.m. and 12:00 noon; on other weekdays between the hours of 2:00 a.m. and 7:00 a.m.; on other Sundays between the hours of 2:00 a.m. and 12:00 noon.
B. 
During the hours that sales are prohibited, the entire licensed premises shall also be closed, but this subsection shall not apply to hotels or to restaurants as defined in N.J.S.A. 33:1-1.[1]

§ 70-6 Violations and penalties.

Any person violating any section of this article shall, upon conviction thereof, be subject to a fine not exceeding $500 or to imprisonment in the county jail for a term not exceeding 90 days, or both.

§ 70-7 Prohibitions; permission revoked. [1]

A. 
No operator of a restaurant, dining room or other public place where food or liquid refreshments are sold or served to the general public, regardless of the class or quality of said restaurant or food service facility, shall permit or suffer the consumption of alcoholic beverages for on-premises consumption.
B. 
It is the intent of the Township Committee of the Township of White to revoke any such permission which may appear to have been granted by the legislature in N.J.S.A. 2C:33-27.
