GENERAL REFERENCES
Zoning — See Ch. 122.
No person, firm or corporation, their agents, servants or employees shall install, operate or maintain on private property in the Village any exterior light, lamp or other artificial illumination which is not in compliance with § 79-2.
A.
All exterior lights, lamps and other artificial illumination ("exterior
lighting") shall be arranged, placed, oriented and operated with the
required wattage, reflectors, refractors and screening that will ensure:
(1)
The light beam or any part thereof will not project beyond the property
line of the premises of the owner or occupant.
(2)
The light emitted will not be directed at or towards an adjoining
property or residence on an adjoining property.
(3)
The light source will be oriented, hooded and shielded to the degree
necessary and equipped with the minimum wattage so that glare from
the light source will not be an unreasonable nuisance to the adjoining
property. For purposes of this chapter, lighting glare shall constitute
an unreasonable nuisance to an adjoining property if the light projected
exceeds 0.2 of a footcandle at any point on the adjoining property
in the A-1 (three-acre) Zoning District. In the A-2 (1/2) Zoning District,
the projected light may not exceed 1.0 footcandle.
(4)
No light shall be directed upon any surface that shall reflect the
beam beyond the property line of the premises of the owner or occupant.
Light trespass or overspill shall not create shadowing discernible
without instruments on any residentially zoned premises.
(5)
The mounting height of any exterior light shall not exceed 20 feet
as measured from median grade.
(6)
No exterior light shall be placed so as to shed light directly upon
any right-of-way or public street so as to interfere with motorists
vision or otherwise affect safe driving conditions on any street.
(7)
Garage doors shall be kept closed from dusk until dawn, except for
ingress and egress, whenever light emitting therefrom contributes
to light trespass in excess of levels permitted by this chapter.
(8)
Whenever a rheostat controls exterior lighting, the brightness produced
by the subject light fixtures shall be tested for compliance at full
rheostat power. In the event that the light trespass at such full
rheostat power does not comply with this chapter, additional reduction
in candlepower and additional shielding and/or reduction of the number
of light fixtures may be required by the Building Inspector.
(9)
Whenever there is a conflict or discrepancy as to the standards of operation set forth in this chapter with respect to maximum exterior light trespass or overspill, such conflict or discrepancy shall be resolved in favor of the footcandle standard set forth in Subsection A(3) hereof as detected by a suitable light meter capable of such measurement.
B.
No flashing, fluorescent or neon exterior lights shall be permitted
in any residential district. Holiday lighting, comprised of string
lighting and other illuminated articles, shall be permitted only during
the traditional period, or when not visible from the roadway or adjoining
property.
No exterior lighting used to illuminate a residential entrance
sign or pier shall be permitted when the light used for illumination
is reflected on any adjoining property or roadway. No exterior safety
mirrors shall be permitted without the express written permission
of the Village Police Department and the Village Architectural Review
Board.[1]
Any exterior lighting installed prior to the effective date
of this chapter in violation of the above standards shall be brought
into compliance with the provisions hereof within six months thereafter.
Any relief granted by the Building Committee or Board of Trustees
to any Village resident prior to the effective date of this chapter
shall expire six months from the effective date of this chapter.
The Zoning Board of Appeals of the Village, after a public hearing,
may grant variances from the requirements of this chapter pursuant
to its authority to grant variances under the Village Law.
The applicant for any required permit for work, including new
construction or renovation or both, which involves exterior lighting
shall submit to the Building Inspector and the Architectural Review
Board a lighting plan showing that the proposed work will comply with
this chapter. The plan shall contain and depict the following information:
A.
The location, height, make, model, lamp type and wattage of each
outdoor lighting fixture.
B.
A certification by an appropriate professional that the total light
trespass from the applicant's property shall not exceed the limits
in this chapter, with rheostat, if any, at full power.
C.
A certification by an appropriate professional that all exterior
lighting fixtures are shielded or constructed so that all light emitted
is projected below a horizontal plane running through the lowest part
of the fixture.
D.
Any additional information the Building Inspector or
the Building Committee may determine is necessary, including but not
limited to luminance level profiles.
