Pursuant to the authority of Section 702 of the Second Class Township Code, 53 PS. § 65702, the following streetlighting districts are hereby established and shall be regulated pursuant to the provisions of this chapter:

NOTES:
1 These properties consist of a total of seven office condominium units. The total front footage for the common ground is 138.37 feet. The front footage has been equally assessed to each of the seven units for a total front footage for each unit of 19.76 feet.
2 This parcel that joins Parcel 390000394008 which is assessed with Parcel 390000391002. The two parcels have a total of 214 feet along Bethlehem Pike and the total front footage will be assessed against Parcel 390000391002 in accordance with procedures already in place for real estate taxes.
3 This property consists of three units with a total front footage of 154.94 feet along Bethlehem Pike. The total front footage has been assessed equally among the three units for a total of 51.65 feet per unit.
4 These two parcels are office condominium units located on common ground known as Parcel 390003100002 which has a total of 252.67 feet along Bethlehem Pike. The common ground parcel is not taxed and the front footage has been equally split between the two condominium units for a total of 126.33 feet along Bethlehem Pike.

§ 1050.02 Assessment for streetlighting costs using benefit method.

(a) 
The annual cost of streetlighting for any streetlighting district described in 1050.01 above shall be equally allocated or assessed through a uniform annual assessment upon each of the benefitted properties included within the streetlighting district.
(b) 
Such assessment shall consist of the annual cost of streetlighting charged to the Township by the Philadelphia Electric Company (or any succeeding utility) for the previous fiscal year.
(c) 
Said cost shall be assessed against the benefitted properties by uniform annual assessments against each property located within the district.
(d) 
Such assessments shall be chargeable against all designated properties within the district, whether or not such property is improved with buildings or structures of any kind, unless such property is intended to be left permanently unimproved.
(e) 
Unless adjusted by the Board of Supervisors pursuant to 1050.03 below or unless the Supervisors select a different method of assessment as permitted by the Second Class Township Code, all such assessments shall be computed by dividing the total annual cost of streetlighting within the district by the number of individual tax parcels within the district, as listed in this chapter.

§ 1050.02.1 Assessment for streetlighting costs using front foot method.

(a) 
The annual cost for any streetlighting district described in Section 1050.01.1. above shall be assessed utilizing the front foot method for properties located within the specified streetlighting district.
(b) 
The per linear foot assessment amount shall be established on an annual basis by the Lower Gwynedd Township Board of Supervisors (the "Supervisors"). In the event a new amount is not established during the annual budget period, the previous year's per linear foot assessment amount shall be utilized.
(c) 
The assessment shall be chargeable against all designated properties within the district, whether or not such property is improve with buildings or structures of any kind, unless such property is intended to be left permanently unimproved.

§ 1050.03 Adjustments.

It shall be the responsibility of the Board of Supervisors, in conjunction with the Lower Gwynedd Township Tax Collector, to adjust the annual assessments within any individual streetlighting district for a particular year. Any underestimation or overestimation of costs as reflected in an annual assessment shall be adjusted as necessary through the following year's adjustment.

§ 1050.04 Collection procedure.

For any streetlighting district which is not represented by a homeowner's association, the Tax Collector shall include the assessment for each individual parcel as a separate line item in the annual assessment for the benefitted parcel. The owner of the benefitted parcel shall be required to pay the streetlighting district assessment as designated by the Tax Collector. In the event that all of the benefitted parcels within a certain streetlighting district are represented by a homeowner's association, the Township, at its option, may require the homeowner's association to collect the streetlighting district assessment from each member of the homeowner's association. The Township Board of Supervisors or the Tax Collector may then bill the homeowner's association for the sum total of all of the individual assessments within the streetlighting district at regular intervals as shall be determined by the Township Board of Supervisors or the Tax Collector.

§ 1050.05 Nonpayment of assessment.

In the event that the annual assessment for streetlighting is uncollected, the same shall be a lien against each individual parcel benefitted and shall be collectible in the same manner as other municipal claims.
