This chapter is enacted as a measure to safeguard the residents of the Borough of Ho-Ho-Kus and to protect their property.
No person or persons, while engaged in hunting, target shooting, practice shooting or otherwise within the limits of the Borough of Ho-Ho-Kus, shall at any time fire or discharge, or cause to be fired or discharged, any pistol, shotgun, rifle or other firearms. However, nothing in this section shall prohibit the use of firearms for the protection of life, person or property, or by any law enforcement officers, and provided further that the provisions hereof shall not apply to any pistol or rifle range equipped with proper safeguards for the protection of life and property and approved by the Chief of Police.
Ordinance No. 231, entitled "An Ordinance to Prohibit Hunting within the Limits of the Borough of Ho-Ho-Kus," passed September 30, 1946, and any other ordinances or parts thereof inconsistent with the terms of this chapter be and the same are hereby repealed.
Any person or persons violating any of the provisions of this chapter shall, upon conviction thereof, be liable to a fine not exceeding $50 or by imprisonment for a term not exceeding 30 days in the county jail for each offense, or both.
In the event that any section or part of this chapter shall be held invalid, such adjudication shall apply only to the section or part so adjudged, and the remainder of said chapter shall be deemed valid and effective.
This chapter shall take effect when passed and published as required by law.
