N.J.A.C. 8:24-1.1 et seq. (Sanitation in Retail Food Establishments and Food and Beverage Vending Machines) shall be enforced in the City of Burlington.
No person shall operate a retail food handling establishment without a license issued by the Board of Health. The license shall be posted in a conspicuous place in such establishment.
The charge for a retail food handling license or approval of an existing license shall be as set forth in Chapter 146, Fee Schedule, of the Code of the City of Burlington.
Licenses issued under this chapter shall expire annually on December 31 and application for renewal thereof shall be submitted together with the required fee prior to January 31 of each year.
A license issued under this chapter may be suspended or revoked for a violation by the holder of any provision of this chapter or the code adopted by this chapter after an opportunity for a hearing before the Board of Health or its authorized representative.
The license issued under this chapter is not transferable.
Any person who violates any provision of this chapter or order promulgated under this chapter, or of the code adopted by this chapter, shall be subject to a fine of not less than $100. Each day a particular violation continues constitutes a separate offense.
