It shall be the duty of the Police Department to enforce the traffic regulations of the City, to make arrests for traffic violations and to carry out those duties specifically imposed upon the Police Department by this chapter.[1]

A. 
The violation of any of the provisions of Article VII or § 11-165 of Article XVII of this chapter shall be punishable by a fine of not more than $10 for the first offense and by a fine of not more than $25 for the third or any subsequent offense in one year; provided, however, that no fine shall be levied for any offense with respect to which a payment required by Subsection B(2) of this section shall have been made.
B. 
Police action.

(1) 
Police officers and other authorized officers and persons shall report the following information concerning every violation of the provisions of Article VII, and § 11-165 of Article XVII of this chapter: the registration number of the vehicle involved, the place where the violation occurred, the time the violation occurred, the badge number or the initials of the police officer reporting the violation and all other facts necessary to a thorough understanding of the circumstances attending the violation.
(2) 
Every police officer and other authorized officers and persons reporting such a violation shall place on the vehicle a notice to the owner thereof that the vehicle has been parked in violation of the provisions of Article VII or §§ 11-165 and 11-166 of Article XVII and instructing the owner to report to the Traffic Violations Bureau of the City of Cortland in regard to the violation. Within five days from the time when such notice is placed on the vehicle, such owner may pay or cause to be paid to the Traffic Violations Bureau of the City of Cortland as a penalty for, and in full satisfaction of, such violation the monetary sum as indicated by the appropriately check-marked box on the same line thereto. The failure of such owner to make such payment shall render the owner subject to the penalties as provided in § 11-172A of this article.
C.

Except as otherwise expressly provided in this article or in § 11-155E, the violation of any of the provisions of Article I through Article XVII of this chapter shall be punishable by a fine of not more than $100 or by imprisonment for not more than 15 days, or by both such fine and imprisonment.

All fines and forfeitures collected upon conviction or upon the forfeiture of bail of persons charged with violations of any of the provisions of this chapter shall be paid to the Traffic Violations Bureau of the City of Cortland.

There shall be established within and as part of the Department of Administration and Finance a Traffic Violations Bureau. The Traffic Violations Bureau shall have jurisdiction of all traffic offenses as enumerated in Article 14-B, § 371, of the General Municipal Law of the State of New York and all traffic offenses as enumerated in the Code of the City of Cortland pursuant to and under the following articles and sections: Article VII, IX and XV; §§ 11-165 and 11-166 of Article XVII.

The Traffic Violations Bureau so established may be authorized to dispose of violations of traffic laws, ordinances, rules and regulations when such offenses shall not constitute the traffic infraction known as "speeding" or a misdemeanor or felony by permitting a person charged with an offense within the limitations herein stated to answer, within a specified time, at the Traffic Violations Bureau, either in person or by written power of attorney in such form as may be prescribed in the ordinance creating the Bureau, by paying a prescribed fine and, in writing, waiving a hearing in court pleading guilty to the charge and authorizing the person in charge of the Traffic Violations Bureau to take such plea and receive such a fine for and on behalf of the City Court of the City of Cortland. Acceptance of the prescribed fine and power of attorney by the Traffic Violations Bureau shall be deemed complete satisfaction for the violation, and the violator shall be given a receipt which so states. If a person charged with a traffic violation does not answer as hereinbefore prescribed, with a designated time, the Traffic Violations Bureau shall cause a complaint to be entered against them forthwith and a warrant to be issued for their arrest and appearance before the City Court of the City of Cortland. Any person who shall have been, within the preceding 12 months, guilty of a number of parking violations in excess of such maximum number as may be designated by court, or of three or more violations other than parking violations, shall not be permitted to appear and answer to a subsequent violation at the Traffic Violations Bureau but must appear in the City Court of the City of Cortland at a time specified by the Traffic Violations Bureau. Such Traffic Violations Bureau shall not be authorized to deprive a person of their right to counsel or to prevent them from exercising their right to appear in court to answer to, explain or defend any charge of a violation of any traffic law, ordinance, rule or regulation.

The City Court of the City of Cortland shall designate the fines to be paid for offenses which may be satisfied at the Traffic Violations Bureau as hereinbefore stated, provided such fines are within the limits established as penalties for such offenses.

The Traffic Violations Bureau as herein authorized shall keep a record of all violations of which each person has been guilty, whether such guilt was established in court or in the Traffic Violations Bureau, and also a record of all fines collected and the disposition thereof. It shall also perform such other or additional duties and keep such other or additional records as shall be prescribed by the City Court of the City of Cortland and/or the Common Council of the City of Cortland.
