The Superintendent or his or her duly authorized representative shall, in the discharge of his or her duties and in the enforcement of this chapter and for the purposes of inspection and reinspection, have the right to enter upon the properties and the buildings located in the District at a reasonable time for the purpose of determining whether sewer or drain construction on such premises is in accordance with the requirements of this chapter.
A. 
Entry on private land. As provided under §§ 190-23 and 190-42, the Superintendent and his or her duly authorized representatives may enter upon private lands for the purpose of inspection, observation, measurement, sampling and testing in accordance with the provision of this chapter or the rules of the Sewer District. The Superintendent or his or her representatives shall have no authority to inquire into any processes used in any industrial operation beyond that point having a direct bearing on the kind and source of discharge to the sewers or the on-site facilities for waste treatment.
B. 
Observance of safety rules; indemnification.
(1) 
While performing the necessary work on private lands referred to in this section above, the Superintendent or his or her duly authorized representatives shall observe all safety rules applicable to the premises as established by the owner and/or occupant of the premises, and the owner and/or occupant shall be held harmless for injury or death to the Town employees and the Town shall indemnify the owner and/or occupant against loss or damage to their property by Town employees and against liability claims and demands for personal injury or property damage asserted against the owner and/or occupant and growing out of the gauging and sampling operations except as such may be caused by negligence or failure of the owner and/or the occupant to maintain safe conditions as required in § 190-26 or 190-27.
(2) 
Refusal to permit the entry upon private lands required to perform the necessary work referred to in this section shall be punishable by such penalties as may be prescribed under Article XIII of this chapter.
Nothing in this chapter shall prevent an owner or his or her agent from appealing to the Town Board, on written notice to the Superintendent, from any requirement or decision which in the opinion of the owner or agent is unfair to him or her or imposes upon him or her an unusual hardship.
Any person who maliciously, willfully or recklessly breaks, damages, destroys, uncovers, defaces or tampers with any structure, appurtenance, or equipment which is a part of the sewer system shall be in violation of this chapter and subject to the penalties provided herein.
