The assets of the water system, including reservoir property,
waterlines, rights-of-way, cash balance in the water department account
and liabilities, are hereby transferred to the Ligonier Municipal
Authority to be held and operated by said Authority until designated
to do otherwise by subsequent resolution or ordinance of the Council
of the Borough of Ligonier. There is excepted and reserved from this
conveyance any property which, under the terms of the instruments
by which the Borough acquired title, would be forfeited if transferred
to any other entity.
The operation of the water system is hereby transferred to the
Ligonier Municipal Authority until such time as the Authority is directed
to do otherwise by subsequent resolution or ordinance of the Council
of the Borough of Ligonier.
No other projects shall be undertaken by the Ligonier Municipal
Authority unless authorized by subsequent resolution or ordinance
of the Council of the Borough of Ligonier.
No real property or rights-of-way transferred herein shall be
transferred by the Ligonier Municipal Authority to any entity other
than the Borough of Ligonier.
The officers of the Borough of Ligonier are hereby authorized
to execute any deed of conveyance of the reservoir property and to
execute any documents necessary to transfer other assets or operation
of the water system to the Ligonier Municipal Authority.
