§ 35-1 Legislative intent.

The purpose of this chapter is to create and establish a publicity fund and to provide for the appropriate expenditures therefrom in connection with the Village of Flower Hill, New York

§ 35-2 Definitions.

A. 
The terms, words and phrases used in this chapter shall have the same meaning as such terms, words and phrases are defined in the Village Law, Municipal Home Rule Law and other laws of the State of New York.
B. 
As used in this chapter, the following terms shall have the meanings indicated:
VILLAGE
The Village of Flower Hill.

§ 35-3 Establishment; purpose.

A. 
Authority is hereby granted to establish a publicity fund in, of and for the Village of Flower Hill, New York, in accordance with the authority granted under the Municipal Home Rule Law of the State of New York, and it is specifically provided that there shall be established a publicity fund and that proper expenditures therefrom, in whole or in part, may be used for the purpose of publicizing and promoting the Village of Flower Hill, Nassau County, New York, and said fund shall be established on a yearly Village annual basis.
B. 
Further, expenditures may be made from the fund for the specific objects and purposes recited herein and to which the taxes and other revenues of the Village may be appropriated.

§ 35-4 Determination of benefit to Village.

It is determined that certain publicly and privately sponsored parades, festivals, exhibitions, shows, contests, farmers' markets, displays, games, races and other similar events held within the Village for the public at large and which are designed to attract visitors to the area are desirable for the general welfare of the Village inhabitants and are otherwise desirable for the benefit of trade within the Village.

§ 35-5 Appropriations to fund; limitation on appropriations and expenditures.

The Board of Trustees may, in its discretion, make appropriations to the publicity fund hereby established either as part of the annual budget or at any time from unanticipated revenues or from surplus amounts in other accounts. Such publicity funds may not, however, be funded in any fiscal year in an amount greater than $3,000, nor shall annual expenditures from such fund for all qualified objects and purposes exceed the sum of $3,000 in any event.

§ 35-6 Criteria for use.

A. 
The objects and purposes for which expenditures may be made from such publicity fund shall be limited to events which are:
(1) 
Held at least partially within the Village of Flower Hill;
(2) 
Open to the general public from within and without the Village;
(3) 
Likely to provide favorable publicity for the Village or stimulate trade within the Village or shall be beneficial to the general welfare of the inhabitants of the Village by providing instruction, entertainment or amusement; and
(4) 
Primarily sponsored or promoted by a not-for-profit corporation or other nonprofit organization.
B. 
No expenditures from such publicity fund shall be made unless the Village's Board of Trustees shall have first determined, by resolution, the amount of money to be allocated for such event and that the particular event or organization to be benefited by such expenditure meets the qualifying criteria set forth in this section.

§ 35-7 Maximum single expenditure.

No expenditure from the publicity fund shall be made to benefit any single recipient or event in an amount greater than $1,000 in any one fiscal year of the Village.

§ 35-8 Authority of Board to limit use.

Any resolution by the Board of Trustees authorizing the expenditure of money from the publicity fund may contain special limitations upon the recipient's use of any money to be paid by the Village, and the payment of any money so authorized shall be conditioned upon the recipient's satisfactory compliance with the stated limitations.

§ 35-9 Conditions for payment.

No payment from the publicity fund shall be made by the Village until the qualifying event has actually occurred in its contemplated magnitude or the Board of Trustees has determined that the benefit to be derived by the Village and its inhabitants has actually been received.

§ 35-10 Funding not obligatory.

This chapter is not intended to create any right to funding in any person or organization, nor is the Board of Trustees obliged to appropriate any money to the publicity fund or to expend any amount from the publicity fund at any time.
