Unless otherwise expressly stated or clearly indicated by the context, the following terms shall, for the purpose of this chapter, have the following meanings:
HEAVY DUTY
Any motor vehicle with a gross weight equal to or greater than 8,500 pounds or with a passenger carrying capacity of more than 12 persons.
IDLE or IDLING
When the engine of any motor vehicle is running while the vehicle is stationary.
A. 
No person shall permit, cause, suffer or allow the engine of a heavy-duty diesel-powered motor vehicle to idle prior to, during layover between, or at the conclusion of any trip or route for any period of time beyond which is reasonably required to attain, or to secure from, normal operating conditions, within any residential zoning district included under Chapter 7-309 of the City Code titled "Residence Zones." The maximum allowable period of idling shall not exceed two consecutive minutes or zero for layovers, except under the following conditions:
(1) 
The engine may be idle for a period of up to five consecutive minutes when the ambient temperature is less than 32° F.
(2) 
The engine may be idle for a period of up to 20 consecutive minutes when the ambient temperature is less than 20° F.
(3) 
The engine may be idle for a period of up to 20 consecutive minutes for vehicles equipped with air conditioning and nonoperable windows when the ambient temperature is equal to or greater than 75° F.
B. 
No person shall permit, cause, suffer or allow the engine of a heavy-duty diesel-powered motor vehicle to be accelerated while idling at any time.
A. 
Any person, whether individually or as a member or employee of a partnership, or any officer, agent or employee of a corporation, who directs or knowingly permits any violation of any of the provisions of the sections of this chapter, or who aids or assists therein, either on his/her own behalf or in the interests of his/her employer or principal, or who fails to comply with any order made thereunder, or who fails to comply with such order as affirmed or modified by the City, shall, upon conviction thereof, severally and for each violation, be fined not less than $50 and not more than $500 for the first offense and not less than $500 and not more than $1,000 for any subsequent offense.
B. 
The application of the above penalty shall not prevent any other remedy at law or equity available to the City for enforcement of this chapter.
