The intent of the chapter is to promote the health, safety and general welfare of the community by regulating the placement of sidewalk cafes.
All sidewalk cafes must comply with the following general regulations:
A. 
The hosting establishment must maintain general liability insurance for the operation of its business in the outdoor area in the minimum sum of $1,000,000 and shall name the City of Cortland as an additional insured.
B. 
Tables and chairs may not be placed in an area which encroaches on the neighboring properties or in any way disrupts the pedestrian use of the sidewalk.
C. 
The hosting establishment shall comply with all City, county and state rules, regulations, ordinances and laws pertaining to the operation of its business within the outdoor area and provide the City Clerk with verification of such compliance.
D. 
The hosting establishment is responsible for cleaning the outdoor area being used by patrons and for the placement of an adequate number of trash receptacles in the outdoor area being used.
E. 
The tables and chairs must be "outdoor style" furniture and may only be placed in the outdoor area during the hours of operation of the business.
Application for a permit to locate a sidewalk cafe on a public street shall be made upon a form to be provided by the City Clerk. Such application shall be accompanied by the approval of the Planning Commission, which approval shall not be granted without consultation with the Police Chief, Fire Chief and the Superintendent of Public Works. The Planning Commission, in approving such an application, shall take into consideration all of those matters which it must consider when approving a site plan pursuant to Article XII of Chapter 300.
The City Clerk shall issue a one-year permit for the location of a sidewalk cafe upon the approval of the Planning Commission and payment of a fee of $10.
The City Clerk shall renew any permit previously granted pursuant to § 234-4 upon payment of a renewal fee of $10, provided that the Zoning Officer certifies that the sidewalk cafe is in compliance with the general regulations set forth hereinabove in § 234-2.
Such a permit may be revoked or not renewed when the Chief of Police or the Fire Chief indicates that the permitted location presents a hazard to the public safety or when the Superintendent of Public Works indicates that its location impedes the ability of City personnel to undertake a public works project.
