A.
No one shall install a new driveway, modify an existing driveway
entrance onto a Village road or do any work within 25 feet of the
center line of a Village road which affects such road without having
first obtained a permit from the Village of Greenwood Lake Building
Inspector.
B.
If the Building Inspector deems it necessary, the applicant may be
required to provide two copies of plans. Plans must be certified by
a New York State land surveyor, architect or certified engineer.
C.
The applicant shall provide the Building Department with a certificate
of contractor's liability insurance, which names the Village
of Greenwood Lake as certificate holder. Coverage shall include comprehensive
liability with minimum coverage of $1,000,000 bodily injury and $100,000
property in addition to evidence of worker's compensation insurance.
Prior to the issuance of a permit, the applicant shall pay all
fees and make all deposits in accordance with the Village of Greenwood
Lake Fee Schedule.
A.
Driveways shall be paved for a minimum of 25 feet from the edge of
the Village road, with no less than two inches of blacktop, asphalt,
concrete or pavers.
B.
Pipe installed, as required, shall be no less than that required
by the Building Inspector after consultation with the Department of
Public Works. A minimum of four inches of cover from the top of the
pipe to the driveway surface shall be provided.
C.
All driveways over 10% grade shall be paved for the entire length
of the driveway with blacktop, asphalt, concrete or pavers. No driveway
grade shall exceed 15%.
D.
All driveways over 1,000 feet in length from a state, county or municipal
road shall be marked with appropriate markings approved by the Building
Department to facilitate the fighting of fires and provision of emergency
services.
After acceptance by the Commissioner of Public Works and/or
the Village Engineer, the maintenance of the driveway ditch will be
the responsibility of the Department of Public Works.
The driveway shall be installed in accordance with the plans and specifications submitted by the applicant pursuant to section § 117-1 of this chapter.
Any person committing an offense against any provision of this
chapter shall be guilty of a violation punishable by a fine not exceeding
$250 or by imprisonment for a term not exceeding 15 days, or by both
such fine and imprisonment. The continuation of an offense against
the provisions of this chapter shall constitute, for each day the
offense is continued, a separate and distinct offense.
The Zoning Board of Appeals as established by the Village of
Greenwood Lake shall hear and decide appeals and requests for variances
from the requirement of this chapter and shall decide appeals when
it is alleged there is an error in any requirement, decision or determination
made by the Building Inspector in the enforcement or administration
of this chapter. The Zoning Board may attach such conditions as it
deems necessary to an application for relief on order to protect the
health, safety and welfare of the community.
