It shall be unlawful for any person to dam, fill, obstruct or encroach or to maintain his property in a manner that results in the damming, filling, obstructing or encroaching of any sewer, drain, ditch, culvert, gutter, surface drain, storm sewer rights-of-way, or public highway, or portion thereof, or in, under or along any public or private lands, which dam, fill, obstruction or encroachment diverts and/or prevents the natural flow of any stream, creek, brook, river, surface or other drainage water or other watercourse or waterway within the Borough of Raritan, County of Somerset and State of New Jersey.
As used in this chapter, the following terms shall have the meanings indicated:
PERSON
An individual, partnership, corporation or association of persons.
Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof, be subject to a fine not exceeding $200 for each offense or confined to the county jail for a term not exceeding 30 days, or both, in the discretion of the Borough Municipal Court Judge, and each day such violation shall continue shall be deemed and taken to be a separate and distinct offense.
