Unanchored fuel tanks and smaller dumpsters can be easily moved
by floodwaters. Anchoring such structures advances the public safety
and protects the environment by preventing such structures from being
swept away by floodwaters where they can damage houses and buildings
and/or cause fuel spills. All aboveground fuel tanks and dumpsters
as designated below shall be subject to the anchoring and licensing
provisions of this article to minimize the potential for such damage.

The owner of any property in an area of special flood hazard, as defined in § 88-59 of the Code of the Town of Clinton, shall obtain a license from the Town for any aboveground fuel tank or any dumpster of 10 cubic yards or less in volume that is located on the property. Licenses shall be available from the construction office free of charge. Each license shall include a sticker to be affixed in a prominent location to the fuel tank or dumpster and a diagram or diagrams for anchoring fuel tanks and dumpsters.

All aboveground fuel storage tanks and dumpsters of 10 cubic yards
or less in volume shall be securely anchored to the ground by an approved
method.

New aboveground fuel storage tanks shall be anchored in such a manner
that is in accordance with the Uniform Construction Code, N.J.A.C.
5:23-1 et seq.
(2)Â
Existing aboveground fuel storage tanks shall be anchored in such
a manner that will result in the resistance to movement created by
an external force being placed upon the fuel storage tank. This external
force can be due to, but is not limited to, wind or floodwaters. The
anchoring system shall be capable of resisting movement based on the
associated formula to determine the force exerted on the anchoring
system by the fully loaded container.

All dumpsters subject to this chapter shall be anchored in such a
manner that will result in the resistance to movement created by an
external force being placed upon the dumpster. This external force
can be due to, but is not limited to, wind or floodwaters. All components
of the anchoring system shall be capable of resisting a force of at
least 4,730 newtons (1,065 pounds) based on a loaded dumpster's
total average weight of approximately 431 kilograms (950 pounds).

All aboveground fuel storage tanks and dumpsters licensed pursuant to this article shall be inspected by the Code Enforcement Officer within 60 days of issuance of the license for compliance with the anchoring standards described in Subsection A above and annually thereafter. For each annual inspection, the Code Enforcement Officer shall provide the property owner with a new sticker to be affixed to the fuel tank or dumpster as provided in § 80-2.

It shall be a violation for failure to comply with any part
of this article. The Town of Clinton Code Enforcement Officer, Zoning
Official or Police Department shall enforce the provisions of this
article. Any person who shall violate the provisions of this article
shall, upon conviction, be punished by a fine not to exceed $2,000,
by imprisonment for a term not to exceed 90 days or by a period of
community service not to exceed 90 days, or any combination thereof.
