It shall be unlawful for any person to consume any liquor, beer, wine or any other alcoholic beverage while on, in or upon any public highway, street, alley, sidewalk, parking lot or area or the rest or picnic area located between the so-called "Canal Basin Parking Lot" and the bank of the New York State Barge Canal, within the Village of Medina, New York.[1]

Editor's Note: Original Sec. 2, which immediately followed this section, stating that an open container in any vehicle shall be presumptive evidence that said container was in the possession of all occupants of said vehicle, was repealed 10-11-1983 by L.L. No. 4-1983.
The foregoing prohibition shall not apply in the event of a fair, picnic or other community gathering for which special permission has been granted by the Board of Trustees of the Village of Medina specifically granting an exemption from the provisions of this article.
Any person who shall violate the provisions of this article shall, upon conviction, be punishable by a fine of not less than $125 and not more than $250 or by imprisonment for not more than 15 days, or by both such fine and imprisonment.

No person under 21 years of age shall possess any alcoholic beverage in a public place as defined by § 240 of the Penal Law of the State of New York, and any alcoholic beverage found to be in the possession of a person under 21 years of age in any such public place shall be confiscated.
The violation of this article shall be punishable by a fine of not less than $125 and not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment.
