No person shall permit on premises owned or occupied by him any uncovered open well.
A violation of this Article shall be a misdemeanor and shall subject the violator to a fine of not more than $10 or imprisonment for not more than 10 days, or both, and each day shall be a separate violation.

In order to maintain the water table of the Town of Bethany in a suitable condition in keeping with the public health, welfare, and safety of the Town of Bethany, its residents and property and in order to maintain a supply of water sufficient to provide adequate fire protection for its growing population and property and in order to conserve and retain the natural resources of the Town of Bethany, the drilling of water wells within the boundaries of Bethany for the purpose of extracting therefrom water for sale, lease or other commercial disposition outside the boundaries of Bethany is prohibited.
A fine of $100 per day for each day of operation in violation of this Article, after due notice to desist has been received by the person, firm or corporation sought to be so charged, shall be levied against any person, firm or corporation found to be in violation. Said notice referred to herein shall be sent by registered mail, return receipt requested.
