GENERAL REFERENCES
Special school police — See § C-1307.
There is hereby established, pursuant to Act No. 108 of 1979, effective January 1, 1980, the Educational Service Agency of the Borough, effective January 1, 1980, which Agency shall be operated exclusively for the purpose of providing service to one or more educational institutions as more fully set forth in such Act.[1]

The Educational Service Agency shall consist of nine members, who shall serve without compensation, but who may be reimbursed for necessary and reasonable expenses. The Mayor, members of Council and the Manager may serve as members of the Agency, but shall not, by reason of membership therein, forfeit the right to exercise the powers, perform the duties or receive the compensations of the municipal offices held by them during such membership.
All members of the Educational Service Agency shall be appointed by Council. The term of each of the members of the Agency shall be four years, or until his or her successor is appointed and qualified.
All of the members of the Educational Service Agency shall be residents of the Borough.
Any member of the Educational Service Agency, once qualified and appointed, may be removed from office for malfeasance, misfeasance or nonfeasance in office or for such other just cause as determined by a majority vote of Council, taken after the member has received 15 days' advance notice of the intent to take such a vote. A hearing shall be held in connection with the vote if the member requests it in writing. Any appointment to fill a vacancy created by removal shall be only for the unexpired term.
The Educational Service Agency shall elect a Chairperson and Vice Chairperson and create and fill such other offices as it may determine. Officers shall serve annual terms and may succeed themselves. The Agency may make and alter bylaws and rules and regulations to govern its procedures, consistent with this Code, the Borough Charter and the laws of the commonwealth. The Agency shall keep a full record of its business and shall annually make a written report to Council, by April 15 of each year, of its activities. Interim reports may be made as often as may be necessary or as requested by Council.
Council may appoint a Director of the Educational Service Agency who shall be, in the opinion of Council, qualified for the duties of his or her position. The Director shall be in charge of the administration of the Agency and shall exercise the powers and be subject to the duties that are granted or imposed on the Agency by this chapter, the Borough Charter and any other applicable law or ordinance, including, but not limited to, Act No. 108 of 1979, as amended. The Director shall exercise only those powers and be subject to only those duties which are specifically conferred upon him or her by ordinance pursuant to this chapter.
The Educational Service Agency, with the advice and consent of Council and within the limits of funds appropriated by Council, may employ special school police (school crossing guards), secretaries, clerks, legal counsel, consultants or persons to perform other technical and clerical services.
The Educational Service Agency shall perform all acts which may be necessary to fulfill the duties and obligations imposed by law, including, but not limited to, Act No. 108 of 1979, as amended, this chapter and the Borough Charter.
A. 
All special school police (school crossing guards) of the Borough are hereby transferred to the payroll of the Educational Service Agency or to the payroll of the Borough, effective January 1, 1980. Such police shall be compensated from the accounts of the Agency in conformity with Act No. 108 of 1979, as amended.[1]

B. 
All appropriated payroll funds, accounts and records of the Borough in connection with the special school police who are presently employed by the Borough shall be hereafter transferred to, and designated as, the accounts of the Agency.
C. 
The Borough Manager is hereby authorized to take all necessary action in order to establish new bank accounts for the Agency, for the payment of all employees thereof, and to establish other necessary and proper accounts to comply with Act No. 108 of 1979, as amended.
D. 
Compensation and reimbursement:

(1) 
The Borough Manager is authorized from time to time to transfer to the Educational Service Agency sufficient funds to compensate the special school police for the school year beginning February 1, 2017, and at such times as necessary thereafter.
(2) 
The hourly rate of pay for special school police shall be $12 per hour, commencing February 1, 2017.
(3) 
Uniforms.
(a) 
Each newly hired special school police shall be provided one complete new crossing guard uniform at no charge to the said crossing guard at the time of initial hire.
(b) 
Each special school police shall be entitled to be paid the sum of $100 on an annual basis for miscellaneous uniform maintenance, subject to the following:

Neither invoices nor receipts for the one-hundred-dollar maintenance allowance need be submitted.
[2] 
During the first year of initial hire, the one-hundred-dollar allowance shall be prorated on a monthly basis during the crossing guard's first year of service.
(c) 
In addition to the $100 set forth in Subsection D(3)(b) above, each special school police shall be entitled to be paid up to the sum of $200 on an annual basis for uniform replacement, subject to the following:

Invoices and receipts to verify uniform clothing purchase replacement shall be required.
[2] 
A newly hired crossing guard shall not be entitled to be paid or reimbursed any portion of the two-hundred-dollar annual uniform replacement allowance during the first year of service.
(4) 
The Borough Manager is directed to obtain reimbursement from the Keystone Oaks School District of the following amounts of money for each special school police:
(a) 
One-half of the hourly rate for each hour paid to the special school police;
(b) 
One-half of the cost of the base of the Commonwealth of Pennsylvania established workers' compensation insurance rate;
(c) 
One-half of the Educational Service Agency's share of social security tax paid on behalf of each special school police;
(d) 
One-half of all sums for new uniform purchases provided to newly hired special school police under Subsection D(3)(a), plus one-half of all annual uniform maintenance and replacement costs paid under Subsection D(3)(b) and (c) above;
(e) 
One-half of the sum paid by the Borough of Green Tree for liability insurance covering the special school police.
(5) 
The hourly rate of pay set forth in Subsection D(2)a) above shall remain in full force and effect until revised by further action of Council.
(6) 
Schedule of payments.
(a) 
Any payments due under Subsection D(3)(b) above shall be paid in October.
(b) 
Any payments due under Subsection D(3)(c) above shall be reimbursed within 30 days of the date the Borough receives proof of the replacement costs incurred.

All new special school police (school crossing guards) employed by the Borough after January 1, 1960, shall have a mandatory retirement at age 70, but such police may be retained from year to year thereafter on the recommendation of the Mayor, the Chief of Police and the Public Safety Committee of Council. These provisions do not apply to presently employed special school police.
