A. 
The Borough swimming pool shall be open to and used by the public within the dates and during the hours to be established by resolution of Council from time to time.

No person shall be permitted in the Wilson Park swimming pool area between dusk and dawn, except when some special event has been prescheduled by the Borough.
The Borough hereby reserves the right to clear the Borough swimming pool of users thereof at any time, within the normal hours of use, that may be required or deemed necessary in the interest of public health or safety.
Admission to the Borough swimming pool shall be permitted only upon admission passes, the classification and price of which shall be established by resolution of Council from time to time.
All admission passes are hereby declared to be nontransferable and shall constitute licenses only. The Borough reserves the right, at all times, to cancel the license granted by any such admission pass for proper cause, as well as the right to refuse later admission to the swimming pool to anyone whose license has been so cancelled.

The rules and regulations for the use of the Borough swimming pool, sunning areas, refreshment stand area, dressing rooms and all other areas appurtenant thereto and operated in connection therewith are as follows:
A. 
General pool rules.
(1) 
No running in pool area.
(2) 
Only Coast Guard-approved flotation devices allowed in the main pool. Hard toys or objects which may cause injury are prohibited. Balls of the soft nature may be used in the shallow end of main pool between 7:00 p.m. and 8:00 p.m. or at the Pool Manager's discretion.
(3) 
No shoving, wrestling, excessive dunking or manhandling of others will be permitted. No snapping, throwing or dipping in water of towels.
(4) 
Smoking prohibited.

(a) 
Smoking of any and all variety, including but not limited to cigarette, cigar and pipe smoking, electronic cigarettes, vapes, and/or the use of chewing tobacco or rub (snuff) is prohibited in any and all areas of the swimming pool, except that such products may be used only in the paved parking area.
(b) 
No-smoking signs shall be posted in the swimming pool.
(5) 
Food and beverages are only permitted on the concession deck. No food or beverages (except water) are allowed in the grass. Only food purchased at the concession stand is permitted. No food may be brought into the pool.
(6) 
All swimmers must take a shower before entering pool.
(7) 
Persons having skin diseases or open sores are not permitted in the pool.
(8) 
Any person causing or having caused damage to pool or park property will be subject to disciplinary action.
(9) 
Loaning of passes is not permitted. Anyone doing so will lose swimming privileges.
(10) 
No profanity will be tolerated in the pool or park area.
(11) 
No gambling allowed.
(12) 
No alcoholic beverages permitted.
(13) 
No diving from pool deck into shallow areas.
(14) 
No hanging on lane markers.
(15) 
No swimming in diving area.
(16) 
Glass containers are not permitted in pool area.
(17) 
Adults or teenager must accompany toddlers in wading pool area.
(18) 
No patron will be allowed on lifeguard chair.
(19) 
All patrons must respect the lifeguard's whistle.
(20) 
Regular bathing suits only. Cutoffs prohibited.
(21) 
No crossing under the lane markers.
(22) 
Lifeguards are not to converse with patrons while on duty in the guard chair.
(23) 
Grass area for sun bathing only. Soft ball playing in the grass area may be permitted at the Pool Manager's discretion.
B. 
Wading pool rules.
(1) 
If you are taller than four feet, you may not swim in the wading pool.
(2) 
Children must be attended to at all times.
(3) 
No diving or jumping entries from the pool side or gutters.
(4) 
Food may only be eaten in the concession area.
(5) 
Throwing of objects or children is prohibited.
(6) 
No running.
(7) 
No smoking.
(8) 
All other pool rules apply.
C. 
Diving board rules.
(1) 
All persons must be capable of passing a deep water test to go off of the diving board.
(2) 
No more than one person on the diving board at a time.
(3) 
No one may dive off the board until the previous diver is at the ladder.
(4) 
No swimming in the diving area.
(5) 
Only one bounce per dive.
D. 
Waterslide rules.
(1) 
Rider must be five years or older and a minimum of 48 inches or pass a swim test.
(2) 
Swimsuits only, no cutoff jeans.
(3) 
Only one rider at a time.
(4) 
Enter slide in a sitting position.
(5) 
Wait for attendant's starting instructions before riding.
(6) 
Ride slide feet first, either sitting or lying back.
(7) 
Do not stop on slide.
(8) 
No tubes, mats or lifejackets.
(9) 
Exit splashdown pool area immediately using the ladder.
(10) 
Form waiting line on pool deck, not on slide stairway.
(11) 
Warning. Pregnant women and riders with heart and/or back conditions should not use this slide.
(12) 
Warning. Failure to follow slide rules can result in serious injury to yourself and others and loss of your privileges to use the slide.
E. 
General note. Any other regulation and restriction deemed necessary for the safety of all concerned by the Pool Manager may be enforced when necessary.
F. 
Swimming pool hours. Sunday through Saturday: 12;00 noon to 8:00 p.m.

B. 
A violation of the nonsmoking provision of this chapter shall be subject to a fine as follows:
(1) 
First offense: $25.
(2) 
Second offense: $50.
(3) 
Third offense and each offense thereafter: $100.
