GENERAL REFERENCES

As used in this chapter, "motor vehicle" means an automobile, tractor, truck, truck tractor, trailer or other motor vehicle.
Except for motor vehicles regularly used for transportation by the owners or occupiers of private grounds within the Borough, and except for motor vehicles stored or placed on premises in the normal course of a business that is a permitted use or a legal nonconforming use under the Zoning Code, no person shall store any used motor vehicle, junked or otherwise, on the outside of any premises without first having obtained a valid and current Pennsylvania inspection sticker and a valid and current registration plate for such vehicle.
No person shall store or continue to store any used motor vehicle, junked or otherwise, on private grounds, except those excluded in § 328-2, without first having obtained a permit therefor from the Code Enforcement Officer.
Applicants for the permit required by § 328-3 shall apply in writing to the Code Enforcement Officer. The application shall set forth the location and description of the land on which used motor vehicles, junked or otherwise, are to be placed, the number and nature thereof, the manner of storage and the length of and purpose for the storage.
If the Code Enforcement Officer determines that the storage for which the permit required by § 328-3 is requested does not or will not adversely affect the health, safety, general welfare, cleanliness and beauty of the Borough and does not or will not constitute a nuisance, the Code Enforcement Officer shall issue a written permit therefor. Otherwise, he or she shall refuse to issue such permit and shall state the reason for such refusal and give notice thereof to the applicant.
Any person aggrieved by a refusal of the Code Enforcement Officer to issue the permit required by § 328-3 may request and shall be granted a hearing before Council. Such request shall be made by filing with Council a written petition requesting such hearing and setting forth a brief statement of the grounds therefor. Such petition shall be filed within 10 days after the aggrieved person receives notice that a permit has been refused. The hearing shall commence not later than 30 days after the date on which the petition is filed, unless postponed for sufficient cause. Within 30 days after such hearing, Council shall sustain, modify or overrule the action of the Code Enforcement Officer.
Any used motor vehicle, junked or otherwise, stored on private grounds without the permit as required by § 328-3 shall be removed by the owner or occupier of such grounds after notice from the Borough to do so. In default thereof, the Borough may cause the same to be done and collect the costs thereof, together with a penalty of 10% of such costs, in the manner provided by law for the collection of municipal claims, or by an action of assumpsit or a bill in equity.
