This chapter is enacted under the authority granted pursuant
to the General Municipal Law, Municipal Home Rule Law and Village
Law of the State of New York.
The purpose of this chapter is to provide for the health, safety
and welfare of the residents of the Village of Weedsport.
As used in this chapter, the following terms shall have the
meanings indicated:
Any equipment, device or apparatus, or any part thereof,
which is installed, affixed or situated separate from an occupied
residence or structure for the primary purpose of combustion of fuel
to produce heat or energy used as a component of a heating system
providing heat and/or hot water for any occupied residence, structure
or space.
The installation and/or use of outdoor furnaces/wood boilers
is hereby prohibited within the Village of Weedsport.
B.
Injunctive relief. An action or proceeding may be instituted in the
name of the Village of Weedsport, in a court of competent jurisdiction,
to prevent, restrain, enjoin, correct, or abate any violation of this
chapter.
C.
Remedies not exclusive. No remedy or penalty specified in this chapter
shall be the exclusive remedy or penalty available to address any
violation of this chapter.
