The Borough of High Bridge recognizes the volunteer emergency/rescue service, known as the "High Bridge Emergency Squad, Inc.," which shall be the basic life emergency medical service unit for the Borough of High Bridge.

As used in this chapter, the following terms shall have the meanings indicated:
EXECUTIVE COMMITTEE
The officers of the High Bridge Emergency Squad, Inc., specifically the President, Vice President, and Chief.
LIAISON
A member of the Council appointed by the governing body.
LINE OFFICERS
The operational body of the High Bridge Emergency Squad, Inc., specifically the Chief, Assistant Chief, Captain-EMS and Captain-Rescue of the Squad.
OFFICERS OF THE ORGANIZATION
President, Vice President, Corresponding Secretary, Recording Secretary, Financial Secretary, Treasurer, three Trustees, Chief, Assistant Chief, Captain-EMS, Captain-Rescue, Director of Equipment, Assistant Director of Equipment/EMS, Assistant Director of Equipment/Rescue, and Training Officer.
SQUAD
The voluntary ambulance squad or rescue squad, also known as the "High Bridge Emergency Squad, Inc."
TRUSTEE
Elected officer serving three-year term. The term is staggered so one Trustee is elected each year.
The Squad shall, in emergencies, and when called upon, render emergency medical and rescue services to the citizens of High Bridge and surrounding communities in accordance with this chapter and with all applicable federal and state statutes, rules and regulations, and in accordance with all bylaws, rules and regulations established by the Bylaws of the High Bridge Emergency Squad (Revision 12-5-2004), the New Jersey Department of Health and the New Jersey First Aid Council.
A. 
The Squad shall consist of active members, including officers, but may include such number of additional inactive members as may be determined in the Squad bylaws. The Squad may deem it necessary to have paid or hired workers to cover certain shifts, but shall remain a volunteer organization.
B. 
As a condition for membership and continued membership in the Squad, each member shall meet the requirements of the Bylaws of the High Bridge Emergency Squad, the New Jersey Department of Health and the New Jersey First Aid Council.
An applicant for membership in the Squad shall satisfy all applications requirements for membership set out in The High Bridge Emergency Squad Bylaws, Article V.
The officers of the Squad, their appointments and terms, shall be designated in the High Bridge Emergency Squad Bylaws, Article II, all of whom shall be active members of the Squad at the time of their election and throughout the period during which they hold such office.

Any vacancy in the offices shall be filled in accordance with the bylaws.
A. 
The powers and duties of the officers of the Squad shall be designated in the High Bridge Emergency Squad Bylaws, Article III, throughout the period during which they hold such office.
B. 
The acquisition of any apparatus or equipment, the making of any purchase, or the entering of any contract, the cost or contract price of which, in whole or in part, is to be paid directly, with or out of Borough public funds, shall be acquired, made or entered into only in accordance with applicable law and the Borough's standard purchasing procedures.
The President of the Squad shall, immediately after the first Monday in April of each year, deliver to the Borough of High Bridge Mayor and Council a full and correct inventory of all the apparatus, equipment, furniture and fixtures in the possession of such company and belonging to the Squad. Any failure or refusal on the part of a Squad to make and deliver such inventory, and any willful incorrectness or misstatement in any such inventory, shall be reported to the Mayor, and it shall be the duty of the President to submit to the Borough Mayor and Council at the second regular meeting of April of each year the aforesaid inventories which shall be filed by the Borough Clerk.

The Squad will adopt, amend and supplement its existing bylaws, rules and regulations which shall provide for the administration and operation of the Squad and prescribe the duties and rules of conduct of the members hereof, and shall contain such other matters as are necessary or useful for the proper functioning of the Squad. Said current bylaws shall be filed with the High Bridge Borough Clerk as a matter of public record.
B. 
Said bylaws, rules and regulations and any amendments or supplements thereto will be adopted according to the Bylaws of the High Bridge Emergency Squad, Article XI. The Squad will forward any amendments to the bylaws to the Borough Clerk within 10 days of amendment having been approved by the membership of the Squad.

All complaints by citizens against officers or members of the High Bridge Emergency Squad, Inc. shall be made to the High Bridge Emergency Squad Executive Committee in writing. The complainant shall state briefly the grounds of the complaint and the rules and regulations which have been violated. Such complaints shall be heard at a time fixed by the High Bridge Emergency Squad Executive Committee, which shall make such rules and regulations for the hearing as in its discretion and shall best promote the ends of justice. If the complainant is not satisfied with the decision of the Executive Committee and he/she has directed the complaint to the Borough of High Bridge, Mayor and Council will advise the Council liaison to act as an informal mediator, who will report back to the Mayor and Council with the final resolution.
The reprimand, suspension or expulsion of any Squad member shall be designated in the High Bridge Emergency Squad Bylaws, Article VII.
A. 
The High Bridge Emergency Squad is a volunteer organization and as such relies on donations from the Borough of High Bridge, surrounding municipalities and private individuals and is expected to raise money for its operations and remain financially responsible. The Mayor and Council of High Bridge will provide a yearly donation, as it deems necessary for thorough and efficient emergency and rescue operations. The Borough Mayor and Council will provide an appropriate building as a home base for the organization, with the stipulation that it remains a volunteer organization, and will contribute financial support for vehicles, building and equipment, as it determines to be fiscally prudent in providing for efficient and comprehensive emergency care for its citizens.
B. 
The Mayor and Council may require the High Bridge Emergency Squad to furnish financial records and may request an audit at the Borough's expense to verify those records. It is the responsibility of the High Bridge Emergency Squad to provide for accurate accounting of its finances and to comply with the Mayor and Council regarding review of these records.

A. 
For purposes of this chapter, a "criminal history record background check" means a determination of whether a person has a criminal record by cross-referencing that person's name and fingerprints with those on file with the State Bureau of Identification in the Division of State Police and the Federal Bureau of Investigation.
B. 
The Borough requires that, as a condition of membership with the High Bridge Emergency Squad, all prospective members shall submit to being fingerprinted in accordance with applicable state, federal, county and local laws, rules and regulations.
C. 
As a further condition of membership with the High Bridge Emergency Squad, all prospective members shall authorize the Borough, through its duly authorized representative, to exchange fingerprint data with and receive criminal history record information from the State Bureau of Identification in the Division of State Police and the Federal Bureau of Investigation.
D. 
In order to obtain criminal history record information pursuant to this chapter and N.J.S.A. 40:48-1.4, the Borough shall submit the fingerprint data for prospective members of the High Bridge Emergency Squad to the State Bureau of Identification in the Division of State Police. The State Bureau of Identification shall receive all criminal history record information from the Federal Bureau of Investigation and shall disseminate that information to the Borough.
E. 
The Borough shall conduct a criminal history record background check of a prospective member of the High Bridge Emergency Squad only upon receipt of the written authorization and consent to the criminal history background check from the prospective member. A form for the authorization and consent to said background check shall be provided to each prospective member along with the application for membership with the High Bridge Emergency Squad. Failure to submit a fully signed and witnessed written authorization and consent form shall be grounds to reject an application for membership with the High Bridge Emergency Squad.
F. 
The Borough shall bear the costs associated with conducting criminal history record background checks in accordance with N.J.A.C. 13:59-1.3(c).
G. 
An individual shall be disqualified from serving as a member of the High Bridge Emergency Squad if that prospective member's criminal history record background check reveals a record of conviction of any of the following crimes and/or offenses as set forth in N.J.A.C. 8:40A-6.2(d), unless a waiver has been granted as provided in N.J.A.C. 8:40A-6.2(c)2:
(1) 
Any crime;
(2) 
Any disorderly persons offense; and/or
(3) 
A petty disorderly persons offense involving the possession, utilization, sale and/or distribution of any controlled dangerous substance; representing a risk of harm to the health, safety or welfare of patients; and/or involving patient abuse or patient neglect.
H. 
All prospective members, upon receiving a conditional offer of membership with the High Bridge Emergency Squad, shall submit their name, address, fingerprints and written consent to the Borough for the criminal history record background check to be performed. All conditional offers of membership with the High Bridge Emergency Squad shall be specifically subject to the prospective member passing the criminal history record background check, along with any other requirements as provided by law and/or requested by the Borough.
I. 
Access to criminal history record background information of prospective members of the High Bridge Emergency Squad obtained under this chapter is restricted to authorized personnel of the Borough, who shall include the Borough Administrator, Police Chief, Mayor, Borough Attorney and such other personnel as are specifically designated in writing by the Mayor as having a need-to-know, as may be authorized by federal or state statute, rule or regulation, executive order, administrative code, this chapter and/or resolution regarding obtaining and dissemination of criminal history record background information.
J. 
Criminal history record background information shall not be disseminated to persons or organizations not authorized to receive the records for authorized purposes. Use of this record shall be limited solely to the authorized purpose for which it was given and it shall not be disseminated to any unauthorized persons. Said records are not public records under the Open Public Records Act.[1]
