A.
Sewer charges previously established are hereby amended based on
the following schedule of rates:

Exceptions to individual dwellings: Senior citizens (age 65
or over) and disabled persons having an annual income not in excess
of $20,000 and who fulfill the other qualifying criteria and limitations
as provided in N.J.S.A. 54:4-8.40 et seq., which provides senior citizen
real estate tax deductions, and such senior citizen owns and resides
in a single-family dwelling house, shall be charged a reduced annual
rate of $180 per domestic consumer unit. Qualification determinations
for the reduced rate provided for in this senior citizen exemption
shall be made in accordance with the standards in effect for determining
real estate tax deductions under the provisions of N.J.S.A. 54:4-8.40
et seq., and as said section shall be amended from time to time, together
with any applicable regulations promulgated thereunder, with the noted
exception of the income limitation being raised to $20,000 in accordance
with this chapter

B.
Notwithstanding any of the provisions of this chapter hereinabove
set forth, any sewer connection to any commercial, industrial or business
establishment using 25,000 gallons of water or more quarterly, based
on regular meter readings, shall pay $56 for the first 26,000 gallons
and $56 for each additional 26,000 gallons or portion thereof. In
addition, the Borough Council shall, by resolution, determine any
additional charge that may be required based on quality of the sewage
in addition to the quantity herein provided for.

C.
In any special case not covered in the schedule of rates set out
in this chapter or not clearly defined therein, the Borough Council
is hereby authorized to establish special rates under such schedules
or formulas as the Borough Council may deem necessary.
D.
A connection charge of $250 for each residential sewer connection
and $500 for each commercial or industrial connection shall be levied
before connection is made.
E.
There shall be no sump pumps connected to the sanitary sewer system
without the express written consent of the Borough Council. The Borough
Council shall approve the connection of a sump pump to the sanitary
sewer system. An annual fee of $100 per sump pump shall be assessed.

All sewer charges herein provided for shall be billed quarterly
on the first day of March, June, September and December.

Any person violating or failing to comply with any of the provisions of this chapter shall, upon conviction thereof, be punishable as set forth in Chapter 1, Article I, § 1-15, General penalty. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.

If there is a failure to make payment due or if a violation
of the rules, regulations or procedures set forth in this chapter
is found on any premises serviced by the Borough of Westville sewer
system, the water will be discontinued as indicated in one notice
sent to the owner of record. When the water service is shut off for
violations of this chapter or for failure to make payments when due,
the water service shall not be turned on until all bills are paid
in full, including the additional turn-on charge.
