A.
In 1996 the Town Board established the Department of Environmental
Services and combined into one department various functions of the
Town. This combination of departments has been quite successful, has
reduced Town expenses and provided for greater coordination of work
amongst various departments.
B.
At the current time in evaluating the operations of the Town, the
Town Board has determined that it would be appropriate to remove from
the Department of Environmental Services the Recreation Division and
to make it a stand-alone department within the structure of Town Government.[1]
C.
It is with this intent in mind that the Town Board does hereby adopt
this chapter.
There is hereby established in the Town of Cortlandt the Department
of Recreation and Conservation. Said Department shall be responsible
for the operation and administration of all the recreation programs
within the Town.
The Department of Recreation and Conservation shall cooperate
fully with the Department of Environmental Services[1] and shall coordinate with said Department all needs for
maintenance and physical repairs and/or other actions with respect
to the facilities that it supervises or operates programs on.
The Director of Recreation and Conservation Department will
be a department head pursuant to Town Law. The Director will oversee
the day-to-day operations of the Department. The Director will report
on a regular basis to the Supervisor and Town Board such information
as is necessary for the Town Board to ensure the proper functioning
of the Department.
The Town Board shall have the authority to designate a Deputy
Director of the Department in its sole discretion and deemed appropriate
and necessary.
There shall be one recreation supervisor who shall oversee the
recreation staff.
A.
Parks. The Department shall be charged with the day-to-day care and
maintenance of all parkland owned by the Town of Cortlandt and shall
keep the same in a manner that is usable for Town purposes.
B.
Recreation. The Department shall be responsible for the operation
and administration of all of the recreation programs within the Town.
C.
Advisory Board appointed; membership and term. There shall be appointed
an Advisory Board for the Recreation and Parks Service Area, which
shall be appointed by the Town Board of the Town of Cortlandt. The
Board shall consist of up to 12 members who shall be residents of
the Town of Cortlandt, appointed for a term of three years, each to
expire at the end of the calendar year, except that the four student
members, as set forth below, shall be appointed for a one-year term.
The members who shall constitute the Advisory Board for Recreation
and Parks Services will be selected with a view towards their demonstrated
interest in the parks and recreation programs of the Town of Cortlandt
and, to the extent possible, shall be persons of diverse backgrounds
from different geographical areas of the Town of Cortlandt. In addition
to the 12 members of the Board, there can be an additional four members
of said Board consisting of high school students who shall be appointed
for a term of one year.

(1)
Vacancies; compensation; officers.
(a)
Any vacancy for a position on the Advisory Board of the Recreation
and Parks Service Area shall be filled for the unexpired term in the
same manner in which the original appointment was made.
(b)
The members of the Advisory Board shall serve as such without
compensation but shall be entitled to receive their reasonable actual
disbursements and expenses in performing the duties of their office.
The Director of the Recreation and Conservation Department shall set
forth procedures for the reimbursement thereof.
(c)
The Advisory Board's Chairman and Vice Chairman shall be appointed
by the Town Board.
D.
Administrative powers; annual report. The Director of the Recreation
and Conservation Department shall have and exercise, subject to any
inconsistent provisions in this chapter, all the administrative powers
necessary for the operation of the Department, including those powers
vested in General Municipal Law § 242 et seq., as well as
such powers and duties as are provided in applicable laws in relation
to the administration of the recreation programs and as required by
the Supervisor and the Town Board.
E.
Powers and duties of Advisory Board; meetings.
(1)
The Advisory Board of the Parks and Recreation Service Area shall
have the following powers and duties:
(a)
To recommend qualifications and specifications which shall be
met by prospective nominees for the various departmental positions.
(b)
To formulate and make recommendations upon basic policy with
respect to the parks, recreation and conservation programs of the
Town.
(c)
To develop and recommend long-range plans for park and open
space acquisitions and facilities development in conjunction with
the Director of the Recreation and Conservation Department.
(d)
To recommend a capital projects plan which shall be submitted
to it by the Director of the Recreation and Conservation Department
annually and, when so approved, shall be submitted to the Town Supervisor
and the Town Board in accordance with the provisions of this chapter.
(e)
To recommend all matters having to do with the regulation, use,
fees and charges with respect to parks and recreation facilities,
which matters shall be referred to the Board by the Director of the
Recreation and Conservation Department.
(f)
To make recommendations upon any proposed sale of parklands,
as herein defined.
(2)
In accordance with the provisions of this chapter, the Director of
the Recreation and Conservation Department shall submit to the Board
for review and approval his estimate of receipts and proposed expenditures
in connection with the preparation of the annual budget prior to submission
of such estimates to the Supervisor and shall set a time for a conference
with the Board on such estimates, which may be the date for a stated
monthly meeting.

The Board shall meet once each month on a stated date to be selected
by the Board and may hold such other meetings as the Board may from
time to time determine. Three members shall constitute a quorum. Whenever
approval by the Board is required, a majority vote of those present
shall be required. Any member of the Board absent for any three consecutive
stated or adjourned meetings shall automatically forfeit his or her
appointment unless renominated by the Director of the Recreation and
Conservation Department and reconfirmed by the Town Board for the
unexpired term. Upon the recommendation of the Chairman and the approval
of the Town Board, the renomination and reconfirmation may be waived
if an active member is absent with justifiable cause.
F.
Recommendation for acquisition of parkland. The Director of the Recreation
and Conservation Department and the Advisory Board may consider, investigate
and recommend to the Supervisor of the Town and to the Town Board
for selection and location such additional real property in the Town
as may, in his or her opinion, be proper and desirable to be reserved
or set apart or acquired for one or more parks.
The Director of Recreation and Conservation is hereby vested
with the authority to formulate and promulgate any rules or regulations
necessary to implement the intent of this chapter. Said rules and
regulations may relate to any aspect of the services provided by the
respective departments. Said rules shall set forth the requirements
and limits for the delivery of these services to the Town and all
rules promulgated hereunder shall be filed with the Town Clerk and
posted upon the Town Clerk's official sign board as well as posted
in all offices of the Town which provide the services set forth herein.
Said rules shall take effect on the 11th day following their filing
with the Town Clerk.

A.
Legislative
intent. Whereas the Town Board from time to time reviews the management
and structure of the Town and determines if it is functioning correctly
and the Town Board has conducted such review and has determined that
in the light of changes in employment that it should restructure a
managerial control of the Office of the Aging, it is with this intent
in mind that this section is adopted.
B.
Office of
the Aging. The Office of the Aging which is responsible for all of
the programs and activities sponsored by the Town with respect to
senior citizens shall become part of the Department of Recreation
and Conservation.
C.
Employees.
All employees of the Office of the Aging shall be members of the Department
of Recreation and Conservation and shall be under the direct general
supervision of the Director of said Department. The Town Board shall
appoint such employees as are necessary to provide for the appropriate
management and supervision of all recreational programs for the senior
citizens of the Town.
