No person, firm or corporation shall operate or conduct a used or secondhand store in the Borough without having first obtained a license therefor and without complying with the provisions of this chapter. The annual license fee for a used or secondhand store shall be $15 and no license shall be issued except upon payment of this fee. The annual license fee shall be from the date of issue for a period of one year and shall be renewable.
Applications for such licenses shall be made to the Borough Secretary in writing and shall include the name and address of the person, firm or corporation of the applicant and shall state the location intended to be occupied by the used or secondhand store. Upon receipt of any such application, the Borough Secretary shall notify the Chief of Police who shall investigate the character of the applicant and shall report to the Secretary the result of such investigation. No license shall be issued to any person of bad character nor to any person who shall have been convicted of receiving stolen goods, burglary or robbery.
Every person operating a used or secondhand store shall keep a record of all articles purchased, including a record of the person who sells such property to the operator of the secondhand store. The record, together with the articles themselves, shall be open to inspection by any member of the Police Department at all reasonable hours.
No person shall have any business dealings as a used or secondhand store operator with any person less than 18 years of age, except with the written consent of the parent or guardian of the minor to each particular transaction.
It shall be the duty of each person who operates a used or secondhand store to report to the police any article pledged to him or which is sought to be pledged with him if he has reason to believe that the article was stolen or lost, and found by the person attempting to pledge it, in the case of a lost article.
In the event that any person, firm or corporation who operates a used or secondhand store in the Borough of Towanda shall violate any of the provisions of this chapter, then, and in such event, they shall be subject to a fine not to exceed $1,000 or imprisonment in the county jail for a period of up to 30 days, or both.
