The requirements for connection to the sewer system shall be as stated in Chapter 400 of the Township of Ocean Code.
Every connection required for this chapter shall be made in accordance with the ordinances and amendments of the Board of Health as well as with the rules and regulations of the Township of Ocean Water and Sewer Utility Department.
Upon receipt of notice that any sewer is available to serve buildings on any property in the Township, each owner of property shall be directed by the Township of Ocean Water and Sewer Utility Department to connect such building on his/her property with the sewer in accordance with the terms of this chapter.
The notice to be given shall be given by the Township of Ocean Water and Sewer Utility Department. All notices shall be addressed to the owners of such property as the name of the owner appears in the last tax duplicate of the Township, shall describe the property by lot and block as it appears on the Tax Map of the Township, and by street address if street address exists. All notices shall state that by order of the Township of Ocean Water and Sewer Utility Department, the owner is required to connect each building on such property with the sewer in accordance with the terms of this chapter on or before 90 days from the date such notice was first given. The notice may be served on the owner personally or by leaving it at his/her usual place of abode with a member of his/her family above the age of 18 years. Such notice may also be served within or without the limits of the Township by mailing it by registered mail to the last known post office address of the owner as the address appears on the last tax duplicate of the Township.
Any person who shall not comply with any order issued in accordance with the provisions within 90 days of the notice thereof by the property officer of the Township of Ocean Water and Sewer Utility Department hereinabove described shall, upon complaint by such officer or any other person, and upon conviction, forfeit and pay a fine of $25 and may also forfeit and pay an additional fine of $10 for each day of delay after the expiration of the ninety-day period in which the provisions of the order or notice are not complied with. Penalties under this chapter may be enforced in the Municipal Court of the Township in the manner prescribed by law.
In addition to the aforesaid penalties as set forth in § 445-5, if the owner of any property in the Township shall fail to make any connection or installation required by this chapter within the time herein prescribed, the Township of Ocean Water and Sewer Utility Department may proceed to make such connection or installation or cause the same to be made and charge and assess the costs thereof against such property with interest at the current legal rate.
