GENERAL REFERENCES
Recycling — See Ch. 130.
No person shall throw, deposit, sweep or abandon upon any public
way or any property owned by the Town or on property of another any
litter. For purposes of this provision, "litter" includes but is not
limited to paper wrappers from sandwiches; paper, styrofoam, or plastic
cups; plastic bags; paper bags; cup lids; cigarette butts; cigarette
packs; gum packs; paper towels; tissues; fruit skins and containers;
bottles, cans, or any other refuse which would be considered trash.
A.
Violation of this chapter shall be punishable by noncriminal disposition
pursuant to the provisions of MGL c. 40, § 21D. For the
purposes of noncriminal disposition, penalty to apply in the event
of a violation shall be as follows: $50 for the first offense; $100
for the second offense; $300 for the third offense and each subsequent
offense. Each day on which a violation exists shall be deemed to be
a separate offense.
B.
This chapter shall be enforced by natural resources officers, harbormasters,
assistant harbormasters, Town police officers, or any other official
so authorized by the Board of Selectmen.
