The following words and phrases and their derivatives, when
used in this chapter, shall have the meanings hereafter ascribed to
them:
The Borough of Edgewater.
Any person who drives a limousine or taxicab within the Borough
of Edgewater and has been properly authorized to do so.
An application for a license to engage in the operation of
a taxicab or livery approved by the Borough if it meets all requirements
of this chapter. The Borough shall issue a certificate of license
permitting the licensee to operate a taxicab or taxi or a livery in
the Borough. In addition, any existing licenses issued by the Borough
and effective on the effective date of this chapter shall be included
in the within definition.
Licensed in accordance with the appropriate sections of this
chapter, unless otherwise stated.
Any automobile or motorcar, other than a bus or taxicab,
which is engaged in the business of transporting passengers for hire,
other than in the conduct of a funeral, and operates out of closed
premises, and which is hired by charter or for a particular contract
or by the day or hour or other fixed period, or charges a fare or
price agreed upon in advance between the operator and the passenger.
Transporting in a taxicab or livery one or more persons for
hire, i.e., accepting a passenger to be transported for hire from
a point of departure within the Borough to a destination within or
without the Borough. The operation of a taxicab or livery by one other
than the owner shall be deemed operation by the owner as well as by
the person actually driving the taxicab or livery. The transportation
of any person, other than the owner or driver, in any motor vehicle
bearing a sign using the words "taxi," "taxicab," "cab," "hack" or
"livery" shall be presumed, in the absence or evidence to the contrary,
to be operation of a taxicab or livery.
Any person in whose name title to any taxicab or livery is
registered with the New Jersey Division of Motor Vehicles or who appears
in the Division's records as a conditional vendee or lessee or
has any other proprietary interest in a taxicab or livery.
A motor vehicle used to transport passengers for hire which
does not operate over a fixed route and is not hired by the day or
hour.
