A code regulating the use, operation and maintenance of food
and beverage vending machines and the licensure thereof, prohibiting
the sale or possession with intent to sell through vending machines
of adulterated or misbranded foods or drinks, authorizing inspection
of vending machines and operations connected therewith and fixing
penalties for violations is hereby established pursuant to N.J.S.A.
26:3-69.1 to 26:3-69.6. A copy of said code is annexed hereto and
made a part hereof without the inclusion of the text thereof herein.
The code established and adopted by this chapter is described
and commonly known as the "Food and Beverage Vending Machine Code
of New Jersey (1961)."
Three copies of said code have been placed on file in the office
of this local Board of Health upon the introduction of this chapter
and will remain on file there until final action is taken on this
chapter for use and examination by the public.
The following information shall be required to be furnished
by each applicant on the form provided:
A.ย Name and address of the applicant.
B.ย Name and address of the person or firm who or which will clean and
service the device or machine.
C.ย Name and address of the manufacturer of the coin-operated vending
device or machine and the serial number of the said device or machine.
D.ย General description of the coin-operated device or machine with reference
to its construction, operation, method of temperature control and
cleaning.
E.ย License displayed in a prominent place on the face of the device
or machine.

The annual license fee to engage in dispensing candy, gum, nuts,
crackers, cookies or bottled soda from a coin-operated vending machine
or device shall be payable to the Board of Health of Clayton as follows:
A.ย Initial application fee: $10.
B.ย First machine or device, per each establishment: $10.
C.ย Additional coin-dispensing machine or device: $5, per each establishment.
Any person who violates any provision of or order promulgated
under this chapter or code established herein shall, upon conviction
thereof, be liable to a penalty of not less than $5 nor more than
$500 for each violation. Each day a particular violation continues
shall constitute a separate offense.
