A.
Penalties. Whoever violates any of the provisions of this chapter
is guilty of a separate offense for each day, or part of a day, during
which the violation is committed or, continued. Unless stated elsewhere,
each offense, upon conviction, is punishable by a civil penalty of
not less than $100 and not more than $2,500 for each offense.
B.
Each day, if the offense is repeated, shall constitute a separate
violation. If the violation relates to damages caused, said party,
if found responsible, shall bear reasonable costs of repair in addition
to any fines and fees assessed hereunder.
C.
Manner and method of service. Notice to owner or to persons responsible
for a violation of this order shall be made in the following manner
and method:
(1)
Unless specifically addressed elsewhere in this chapter, at the discretion
of the acting authority, a warning may be issued verbally or in writing,
so long as such warning is recorded and made available for future
reference.
(2)
If, in the discretion of the acting authority, a citation is deemed
necessary, such citation will be issued in the following manner:
(a)
The citation shall include the name of the responsible person
and/or owner, the date and time of the violation, a general reference
location for the violation, a description of the violation and the
location of and date of appearance at the local court having jurisdiction;
if such date is required by the Court system.
(b)
The citation used is authorized and accepted by the District
Court of the State of Maine;
(c)
Service of the citation is made upon the violator by a person
authorized under law to make such service; and
(d)
The completed citation is properly recorded in the District
Court of the State of Maine having jurisdiction over the violation.
D.
Notice as to permit holders shall, in all cases be sent by certified
mail to their address of record on their permit application.
