Any owner of real property located within Butler Township who desires to apply for inclusion in the agricultural security area, have his or her real property excluded from the agricultural security area or modify the quantity (acreage) that he or she desires to be a part of the agricultural security area must file his or her application, if seeking inclusion, or letter request, if seeking removal or modification, on or before May 1 of each year.
A. 
Applications for inclusion into the agricultural security area.
(1) 
All requests for inclusion in the agricultural security area must be on forms provided by Butler Township. The applicant must submit three copies of his or her application. Each such application must be complete and include the following information:
(a) 
The names of all persons who own the real property.
(b) 
The mailing address of the owner(s) of the real property.
(c) 
The Butler County district, map and parcel identification number.
(d) 
The recording information for the real property (i.e., deed book and page number or instrument number).
(e) 
The number of acres of the real property that is proposed to be included in the agricultural security area.
(f) 
A map showing the boundary of the proposed real property to be included in the agricultural security area (e.g., a copy of the assessment map, a copy of the county GIS map, a United States Geological Survey topographic map, etc.).
(2) 
Each application for inclusion in the agricultural security area must be signed and dated by all property owners, in the case of individuals, or by authorized officers of any association, corporation, partnership or other entity.
B. 
Written requests for removal or modification. Any real property owner who desires to either have his or her real property removed from the agricultural security area or modify the quantity of his or her real property that is currently within the agricultural security area (e.g., remove some but not all or add additional acreage) must submit his or her request on a form provided by Butler Township, together with a letter to Butler Township's Zoning Officer explaining the change the land owner desires. The form shall be the same as the application for inclusion.
Butler Township shall process all applications on the timeline and in accordance with the requirements of the law with acknowledgement of receipt of the application(s) by the Board of Commissioners at the first regular or special meeting held after May 1 of each year. Irrespective of when an application is actually received by Butler Township, it will be deemed to have been received on the next May 1 following the actual date of receipt by Butler Township.
Any application for inclusion, removal or modification received after May 1 will be held by the Township for consideration the following year unless the Butler Township Zoning Officer is notified, in writing, by the applicant that he or she desires to withdraw the application.
