The Finance Director shall be appointed by the Mayor upon recommendation of City Manager and subject to confirmation by the City Council.
The Finance Director, prior to entering into or performing his/her duties, shall take an oath or affirmation complying with the provisions of NMSA 1978, § 3-10-2, as amended, and shall be bonded in an amount equal to 20% of the public monies received by the municipality in the preceding year, to a maximum bond amount of $50,000, pursuant to NMSA 1978, § 6-10-38, as amended.
The Finance Director shall:
A. 
Attend all meetings of the governing body personally or through his/her designee.
B. 
Supervise the depositing and safekeeping of all money belonging to the municipality, and with the advice and consent of the governing body shall designate banks qualified to receive or deposit money entrusted to his/her care (NMSA 1978, § 3-37-1).
C. 
Receive all moneys belonging to the municipality.
D. 
Keep the accounts and records in the manner prescribed by law and accepted accounting principals.
E. 
Prepare, propose and modify annual budgets for approval by the governing body and by the local government division of the Department of Finance and Administration.
F. 
Expend money only as directed by the governing body pursuant to applicable state law and Department of Finance and Administration rules and regulations.
G. 
Submit monthly, or more often if required by the governing body, a report of the receipts and expenditures of the municipality.
H. 
Prepare annually, at the close of the fiscal year, a financial report showing the receipts, expenditures and balances for each fund. A copy of the financial report shall be filed in the office of the City Clerk as a public document (NMSA 1978, § 3-37-3).
I. 
Perform all other financial and supervisory duties and make all reports which are required by the laws of the State of New Mexico or assigned by the City Manager.
Any Finance Director who resigns or is removed from office shall immediately deliver to the City Clerk by memorandum all money, records, property or other things in his/her charge and belonging to the municipality, including any work product created by him/her.
