A system of street parks be and the same are hereby provided
for, and to that end 10 feet on each side of all residence streets,
in the residence portions of the City of Las Vegas, having a width
of 60 feet or more, are hereby set aside for park purposes. Said parkway
area must be kept free of all debris and weeds. The owners of contiguous
property are to create and maintain the same. Provided, however, that
no construction of a permanent nature shall be located in such parkways
without consent of the City Manager.
In all cases the following uniformity shall hereby be established:
In no case shall the parks herein provided for infringe upon
or in any way interfere with the public alleys.
All persons creating parks as herein provided shall maintain
the same, wholly at their own expense, and in no case shall the City
of Las Vegas, in any manner, be liable therefor, provided that in
no event shall a property owner or any other person remove a tree
not in a dangerous condition from a parkway without the permission
of the City.
In all cases persons creating such parks shall first get the
proper lines from the City, and failing to do so, or in any other
respect failing to conform with the provisions of this chapter, the
City reserves the right to establish the proper lines, and change
said park or parks and the sidewalks and curbs to conform to the provisions
hereof, and charge the expenses of so doing against the party failing
to comply with the provision of this chapter and to collect the same
by suit.
