A.
No person shall operate or ride any device commonly known as a "skateboard"
within the Village limits between the hours of 11:00 p.m. at night
to 6:00 a.m. the following morning.
B.
No person shall operate or ride any device commonly known as a "skateboard"
upon or in any of the places stated in the restricted areas.
C.
No person shall operate or ride any device commonly known as a "skateboard"
on a public street or sidewalk:
(1)
In a careless manner without due caution and circumspection.
(2)
While endangering or in a manner to create a risk or danger to any
person or property.
(3)
In any manner to impede or interfere with pedestrian or vehicular
traffic.
(4)
In such a manner as to not have at least one foot in contact with
the skateboard at all times.
D.
No person shall place, locate or leave a skateboard ramp in any public
roadway, including the entire paved and improved surface thereof,
including gutter areas, from curb-to-curb, where curbs exist, or on
any public sidewalk.
Restricted areas shall be as follows:
A.
Streets, roads, highways, including the entire paved and improved
surface thereof, including gutter areas, from curb to curb, where
curbs exist:
(1)
All of Route 259 (Union Street).
(2)
All of Route 31 (Nichols Street).
(3)
All of Big Ridge Road.
(4)
All of Canal Road.
(5)
All of Lyell Avenue.
(6)
All of Church Street.
(7)
All of Slayton Avenue.
(8)
All of East Avenue.
(9)
Amity Street east of Martha Street.
(10)
West Avenue east of Martha Street.
(11)
Coleman Avenue north of Maplewood Avenue.
(12)
Coolidge Avenue north of Maplewood Avenue.
(13)
Prospect Street north of Maplewood Avenue.
B.
Sidewalks:
As used in this chapter, the following terms shall have the
meanings indicated:
A device consisting of a board, regardless of material composition,
to which there is affixed one or more wheels for purposes of supporting
said board and providing locomotion thereto.
Includes all ramps commonly referred to as such, platforms
manufactured or contrived surfaces of any and every pattern or configuration
and other similar devices and things designed for use for riding a
skateboard upon or above any area.
A.
Operation in violation.
(1)
Any police officer whose jurisdiction includes this Village who shall
observe any person using, operating or riding upon a skateboard in
violation of this chapter shall:
(a)
Upon the first violation, take possession of the skateboard
for a minimum period of 48 hours, after which the skateboard shall
be returned to the parent or guardian of a minor violator or, in the
case of an adult violator, to the violator himself. A storage and
handling fee of $25 shall be waived for this first violation.
(b)
Upon the second violation, take possession of the skateboard
for a minimum of 72 hours, after which the skateboard shall be returned
to the parent or guardian of a minor violator or, in the case of an
adult violator, to the violator himself. A storage and handling fee
of $25 shall be paid prior to the release of the confiscated skateboard.
(c)
Upon a third violation and upon each subsequent violation, take
possession of the skateboard for a minimum period of one week, after
which the skateboard shall be returned to the parent or guardian of
a minor violator or, in the case of an adult violator, to the violator
himself. A storage and handling fee of $50 shall be paid prior to
the release of the confiscated skateboard.
(2)
All storage and handling fees are to be paid to the Spencerport Village
Clerk at the Spencerport Village Office during normal business hours.
B.
Skateboard ramps shall not be allowed on any public street or sidewalk.
Any police officer observing a violation of this chapter shall notify
the violator or violators immediately, at which time he, she or they
shall be instructed to remove the ramp to a lawful place. If the ramp
is not so removed, or if notice cannot be immediately given for any
reason, the Village Department of Public Works shall remove the ramp,
and, if unclaimed within seven days thereafter, the ramp shall be
deemed abandoned and shall be disposed of in an appropriate manner.
