As used in these rules and procedures, the following terms shall have the meanings indicated:
POLICE DEPARTMENT or DEPARTMENT
The Department of Police of the Village of Sag Harbor, and such term includes the term "police force."
POLICE FORCE or FORCE
Includes all members of the department except those members appointed to render clerical, mechanical and laboring services, school crossing guards, special police officers, police matrons, radio operators or such other services classified as auxiliary to the Police Department.
The Police Department renders services to the territory within the Incorporated Village of Sag Harbor.
The following divisions, precincts and sectors are established and maintained:
A. 
Headquarters:
(1) 
Office of the Chief of Police.
(2) 
Patrol Sergeants.
(3) 
Identification.
(4) 
Communications Section.
(5) 
Clerical Section.
B. 
Sectors. There shall be established sectors, geographically defined, as deemed necessary, consistent with manpower and need.
A. 
The Officer in Charge shall be the same as Chief of Police and shall have control of the government, administration, disposition and discipline of the Police Department, the police force and the members thereof.
B. 
During the absence or disability of the Chief of Police, the senior ranking officer shall be in full command, and he shall possess all the powers and perform all the duties of the Chief of Police. He shall be known as the "Acting Chief of Police."
C. 
The Acting Chief of Police shall carry out the orders of the Chief of Police, previously given, and such orders shall not, except in cases of extreme emergency, be countermanded or set aside; and, when such action is taken, a report shall be made to the Chief of Police, Police Commissioner or Village Board, stating reasons therefor in each instance.
D. 
The Chief of Police is the ranking and commanding officer of the Department. He is responsible for:
(1) 
Enforcement of the rules and procedure and the orders of the Police Commissioner.
(2) 
The direct supervision of the Headquarters Division.
(3) 
Keeping the Police Commissioner informed of all important matters and of any action taken pertaining to same.
(4) 
The enforcement of all laws and ordinances coming within the jurisdiction of the Police Department.
E. 
It shall be the duty of the Chief of Police to keep adequate records of the police activity and administration as prescribed by law. These records shall be properly maintained and subject to the inspection of the Police Commissioner and the Village Board at any time.
F. 
He shall coordinate all special events for traffic control and supervision at which large groups of people may gather.
G. 
He shall supervise the preparation of state and federal reports of the activities of the Department.
H. 
He shall supervise the uniform reporting procedures and the records and files of the command and ensure their conformity to these rules and procedures.
I. 
He shall supervise on-sight inspection of personnel, equipment, vehicles and command installations.
J. 
He shall prepare memorandums pertinent to the command and ensure dissemination thereof.
K. 
He shall supervise preparation of vacation lists and maintain overtime, sick leave and holiday records.
L. 
He shall be responsible for the tabulation and recording of the weekly attendance records.
M. 
He shall perform such other duties as directed by the Police Commissioner.
N. 
He shall be specifically responsible for maintaining and controlling the issuance, renewals and all records for pistol licenses.
O. 
The Chief of Police shall investigate all accidents in which a police vehicle is involved and shall promptly report to the Mayor.
P. 
The Chief of Police shall inspect, at least once each tour of duty, the memorandum books of members on duty and certify that a full and accurate record of duty performed, alarms and all other necessary information has been entered therein. The Chief of Police shall certify same, entering the date, time and signature.
Q. 
The Chief of Police shall visit all posts, at least once during each tour of duty, shall be responsible for the cleanliness and proper equipment thereof and shall see that they are properly lighted inside and outside at night and extinguished during daylight.
R. 
The Chief of Police shall spot-check school crossing guards.
S. 
The Chief of Police shall submit to the Mayor, by the fifth day of each month, a police officer's activity report for each officer on his shift.
T. 
The Chief of Police shall submit to the Mayor, on the first or second tour of the five-day tours, a vehicle inspection report, on each police vehicle in service.
A. 
Sergeants on duty shall assume acting command of the Department in the absence of the Chief of Police and shall take full charge.
B. 
The Sergeants on duty shall have immediate command and supervision of the subordinate members of the Department, unless the Chief of Police shall assume command personally. Sergeants on duty are charged with supervision of the subordinate members of the Department and must report to the Chief of Police all delinquencies on the part of any officers of the Department which they may observe.
C. 
Sergeants shall require all members of the Department under their command to comply with all rules and regulations and all orders and are responsible for their good order, conduct and discipline. Sergeants shall immediately report, in writing, to the Chief of Police, any breach of a rule or regulation or failure in performance of duty on the part of any officer or any complaint against any officer.
D. 
The Duty Sergeant or duty officer shall notify the Chief of Police, in the following cases of any unusual:
(1) 
Occurrence.
(2) 
Disorder.
(3) 
Fire.
(4) 
Accident.
(5) 
Riot.
(6) 
Homicide.
(7) 
Serious felony assault.
(8) 
Explosion.
(9) 
Robbery.
(10) 
Emergency.
(11) 
In all cases in which there is a doubt in the mind of the Sergeant.
E. 
The Sergeant is responsible to and reports directly to the Chief of Police.
F. 
The Sergeant is second-in-command of the Department and shall assume responsibility in the absence of the Chief of Police.
G. 
He shall assist the Chief of Police in the administration and supervision of the Police Department, enforcement of these rules and procedures and all authorized orders.
H. 
He shall be in charge of all regular and special training of the Department members.
A. 
A police officer shall proceed to his designated relieving post or sector as per schedule and exchange all police intelligence with the officer he is relieving and, as soon as possible, inspect his post or sector and note any conditions thereon requiring police attention. He shall take appropriate action and report same. Failure to do so shall be regarded as neglect of duty.
B. 
A police officer shall not leave or quit his post or sector unless properly relieved. If not relieved upon expiration of tour, he shall contact the Chief of Police and comply with instructions received, but under no circumstances shall be leave or vacate his post or sector.
C. 
A police officer shall not leave or quit his post or sector except for police or personal necessity. If required to leave for police necessity, he shall:
(1) 
Enter in his memo book, as soon as circumstances permit, the time of leaving and the reason.
(2) 
Enter, without unnecessary delay, the exact time of returning to post or sector.
(3) 
At the first opportunity, report to the Chief of Police the fact that he left or quit the post or sector and the reasons for same.
D. 
If compelled to leave or quit his post or sector for personal necessity, he shall:
(1) 
First notify the Chief of Police and request a relief, if a relief is necessary.
(2) 
Return without unnecessary delay.
E. 
A police officer is instructed to check doors in business areas of his post or sector during the hours of darkness, periodically before midnight and periodically after midnight, whenever he is free from other police duties. He shall report to the Chief of Police all doors found open, including the name of the store and address, and shall follow procedure as outlined in the special orders.[1]

F. 
When a police officer or officers are on motorized patrols in business or rural areas of this Village in which are found vehicles or persons who generally have no business therein at late hours of the night, such persons may be made to identify themselves and satisfy the officer in question that such vehicle, person or persons are on legitimate business.
G. 
Each police officer shall execute each and every scheduled tour of duty as posted. The exchange of tours is permissible, provided that same is requested and approved by the Chief of Police and that officers seeking such exchange shall do so in reasonable time.
H. 
The members of the Sag Harbor Village Police Department have the power and it is their duty, at all times of the day and night, to:
(1) 
Protect life and property.
(2) 
Prevent crime.
(3) 
Detect and arrest offenders.
(4) 
Preserve the public peace.
(5) 
Enforce all laws and the ordinances of the Village of Sag Harbor over which the Department has jurisdiction.
A. 
The Communications Section exercises no direct control over duly appointed police personnel. The Communications Section is under the control of the Office in Charge. Members of the Communications Section shall be designated as police officers and Clerks, and shall perform duties in a prompt and businesslike manner. When answering telephone calls, the Clerk or police officer shall first state "Sag Harbor Village Police, may I help you?" Calls must be answered promptly and communications transmitted without delay. Radio transmissions shall be in accordance with Federal Communications Commission regulations. They shall be brief, with emphasis on codes. In the absence of Communications Section members, others may be assigned.
B. 
The Clerk or police officers shall not permit anyone behind the desk, except members of the Department. Other persons shall be confined to the public reception area and shall be permitted to enter other areas only when it will promote the performance of official business.
C. 
The Clerk or police officer shall properly enter, on authorized books and forms, all reports of complaints occurring during his tour of duty.
D. 
It shall be the duty of the Clerk or police officer to record all transmissions and promptly dispatch same to mobile units if received by telephone. The Clerk or police officer, upon receiving a complaint and requiring a radio alarm, shall dispatch to local units, the Sheriff's office of Suffolk County and the New York State Police within the township.
E. 
The Clerk or police officer shall exchange all police matters and intelligence with the police officer about to relieve him.
F. 
The Clerk shall compile the monthly and yearly consolidated reports of the Department and have such other duties as the Chief of Police may direct.
G. 
The police officer shall receive, book, process personal property of and secure each prisoner in accordance with special orders.
H. 
The police officer shall personally visually check each prisoner every 1/2 hour during confinement.
I. 
He shall release each prisoner to a police officer in accordance with special orders and shall complete the necessary records pertaining thereto.
J. 
The Clerk is the liaison officer between the public and the police and shall conduct himself in a courteous and businesslike manner.
K. 
The Clerk shall see that the Communications Section is secure at all times from unauthorized entry.
L. 
The Clerk shall make himself completely familiar with the various special orders, procedures and policies of the Department and shall follow same during the conduct of business.
M. 
The Clerk or police officers shall make themselves completely familiar with the various Village ordinances and local laws in order to impart accurate information toward any inquiry. When in doubt, however, a supervisor or senior police officer should be consulted.
N. 
Additional specific responsibilities shall include:
(1) 
Maintaining, accurately and neatly typed, the official police blotter, which requires signature thereon, on the last line for the tour of duty he has completed.
(2) 
Proper processing of lost and found items and issuing of receipts therefor.
(3) 
Administration and control over the burglar and fire alarm systems.
(4) 
Administration and control over the gasoline distribution.
(5) 
All records keeping activities as directed by the Chief of Police as required by law.
