For the purpose of this article, the subdivision of McCoole
in Allegany County, as hereinafter described, constitutes a special
taxing area or district and shall be deemed and taken to comprise
those certain parcels of land as follows: Beginning at a steel stake
in the west boundary limits of East Maryland Avenue, said stake being
the eastern termination of said avenue; thence crossing said avenue
south 31° 40' west 70 feet to the south side of said avenue;
thence with the south side of said avenue north 58° 20' west
20 feet; thence leaving said avenue south 310 40' west 300 feet
to the south side of East Queen Street; thence with the south side
of said street 59° 40' west 80 feet; thence leaving said
street south 31° 40' west 190 feet to the north boundary
of the Western Maryland Railroad; thence with said railroad for the
next 9 calls north 42° 30' west 182 feet, north 58° 10'
west 850 feet, north 45° 00' west 240 feet, north 37°
00' west 250 feet, north 44° 00' west 210 feet, north
47° 30' west 240 feet, north 58° 00' west 1,140
feet, north 44° 30' west 700 feet, north 51° 00'
west 220 feet; thence leaving said railroad and crossing Maryland
State Highway No. 135 north 26° 00' east 130 feet to a steel
stake; thence north 20° 00' east 50 feet to a steel stake;
thence north 16° 00' east 50 feet to a steel stake; thence
north 37° 00' east 50 feet to a steel stake; thence north
42° 00' east 175 feet to a steel stake; thence north 61°
00' east 1,965 feet crossing U.S. Route No. 220 to Potomac Edison
pole No. G 6609; said pole is located at the intersection of Maryland
State Route No. 135 and Charles Street; thence crossing said route
and street east 350 feet to a steel stake; thence south 54° 00'
east 2,240 feet to a steel stake in the west side of Virginia Avenue;
thence crossing said avenue south 43° 30' east 350 feet to
a steel stake; thence south 52° 00' east 180 feet to a steel
stake; thence south 39° 00' west 800 feet to a steel stake;
thence north 52° 00' west 150 feet to a steel stake; thence
31° 40' west 570 feet to a steel stake; thence 58° 20'
east 230 feet; thence south 31° 41' west 515 feet to the
beginning.[2]

A.
The Board of County Commissioners of Allegany County shall levy and
cause to be collected from the property owners at the time of the
county tax levy for the year 1965 or any succeeding year within this
described area of McCoole, as created in this article, such amounts
not exceeding $0.08 on each $100 worth of assessable real property
other than operating real property of a public utility and $0.20 on
each $100 worth of assessable operating real property of a public
utility in McCoole as may be requested by the Citizens' Committee
hereinafter provided for. Such taxes shall be collected as all county
taxes are collected and shall be paid over by the Board of County
Commissioners to the treasurer of the Citizens' Committee of
McCoole, to be selected from among their number by a majority of the
members of the Citizens' Committee or by their successors to
be selected as herein provided. The Treasurer selected by the Committee
shall give bond to the Board of County Commissioners, to be approved
by a Judge of the Circuit Court of Allegany County, in a penal sum
to be fixed by the Judge, conditioned upon the faithful discharge
of the duties of the Treasurer.

B.
Use. The taxes collected under the provisions of this article shall
be used by said Citizens' Committee for electric lights along
the streets, alleys and public ways of McCoole and for the establishment,
erection and placement of signs along the streets, alleys and public
ways of McCoole as may be necessary or convenient, in the opinion
of the Citizens' Committee of McCoole.

A.
Membership.[1] Each member shall qualify as such Committeeman by taking
an oath before any officer in Allegany County authorized by law to
administer oaths diligently and faithfully to discharge all duties
of the office. In case any such person shall fail to qualify within
30 days after June 1, 1965, or if any of their successors shall fail
to qualify within 30 days after his election or appointment as Committeeman,
as hereinafter provided, or in case of any vacancy through death,
resignation or otherwise, the remaining Committeemen shall fill the
vacancy by the appointment of a resident of McCoole of legal age,
who shall hold office for the term or unexpired term.[2]
B.
Election; terms; officers. On the second Monday in January 1966,
one member of the Citizens' Committee shall be elected to serve
for one year, one member shall be elected to serve for two years,
and one member shall be elected to serve for three years. On the second
Monday in January 1967 and on the second Monday in January of each
succeeding year, an election shall be held at which Committeemen shall
be elected to succeed those whose terms are expiring. The election
shall be by ballot in a manner to be prescribed by the Committee.
Only residents or owners of real property in McCoole of legal age
are entitled to vote for the office of Committeeman in McCoole. Only
residents of legal age in McCoole are eligible to hold the office
of Committeeman in McCoole. Following each election, each newly elected
member of the Committee shall qualify by taking the oath prescribed.
The Committee shall select from its members a Chairman, Secretary
and Treasurer.

A.
Use of funds. The Citizens' Committee provided for in § 166-16 has the power and authority to provide, by contract or otherwise, for electric lights in McCoole and to pay for the same out of the taxes levied by the County Commissioners of Allegany County and paid over to the Treasurer of the Citizens' Committee.
B.
Surplus funds.

Any moneys, from whatever source derived, held by the Citizens'
Committee after making provisions for lights may be expended for the
following:

The expenditure of any surplus funds held by the Citizens' Committee
for the special tax area shall be made only after due consideration
by the Committee and upon a majority vote of the Committee.
(3)
The Treasurer shall pay out of the funds in his possession only upon
the order of the Citizens' Committee and for the purposes authorized
by this article.
C.
Deposit of funds; authorized signatures. The Treasurer of the Citizens'
Committee shall deposit all funds coming into his possession as Treasurer
in such bank as may be approved by the Committee, and they shall not
be paid out except by check duly signed by him as Treasurer and countersigned
by the Chairman or by some member of the Committee acting as Chairman
and so authorized to act by resolution of the Committee, which must
first be spread upon the minutes of said Committee.
D.
Accounts open to public inspection; audit. The Citizens' Committee
may employ an accountant to audit its books and accounts and may also
employ whatever legal counsel it deems necessary. The Citizens'
Committee shall always keep available and open to public inspection
in McCoole its books and accounts.
