The Board of County Commissioners of Allegany County is hereby authorized, directed and empowered to inspect, license, regulate and limit as to location within the limits of Allegany County trailer camps, junkyards, public dumps or lots on which refuse, trash or junk is deposited or motor vehicles are dismantled or stored and, in order to safeguard the health, safety, morals and public welfare of the residents of Allegany County, to pass rules, regulations or resolutions for the purpose of carrying out the powers herein granted, provided that such rules, regulations or resolutions shall contain proper standards for the exercise of the discretion contained herein and shall operate uniformly. Before the County Commissioners shall proceed to enforce any rule, regulation or resolution passed in pursuance of the provisions of this chapter, advertisement of such rule, regulation or resolution shall be made in some newspaper published in Allegany County once each week for four successive weeks.
It shall be unlawful for any person, firm or corporation to operate, set up, establish or conduct any business or enterprise mentioned in this chapter unless said person, firm or corporation shall first obtain from the Board of County Commissioners of Allegany County a license for the operation of such business or enterprise and shall pay to the County Commissioners such sum or sums as may be fixed by the Board for a license fee for the business or enterprise so operated or established.
Any applicant or licensee aggrieved by any action of the County Commissioners taken hereunder shall have the right to appeal to the Circuit Court for Allegany County, provided that such appeal is taken within 10 days from such action.
Any person or persons, firm or corporation which shall operate or establish any business or enterprise mentioned in this chapter without first having procured the license prescribed shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than $25 nor more than $200 for each such violation, and each day on which such violation continues shall be considered a separate offense.
Nothing herein contained in this chapter shall be deemed to authorize the County Commissioners to prohibit or regulate as to present location any business or enterprise therein mentioned which has been established in Allegany County prior to March 28, 1957, but said established businesses or enterprises shall, after March 28, 1957, be maintained and conducted in accordance with the rules and regulations established by the County Commissioners under the authority herein granted.
