A. 
Any collector or other person who desires to place any large bulk container, commonly known as a "dumpster," on a street or other public right-of-way in Mahoning Township shall, prior to such placement, obtain from the Mahoning Township Police Department a permit authorizing such placement.
B. 
As part of the issuance of the dumpster permit, and during the term of the permit, the Township shall require the following:
(1) 
Each dumpster must have reflective tape on each of its corners to provide for visibility of its location during dusk to daylight hours; and
(2) 
Wood planks or wood blocks of at least 3/4 inch must be located and placed under each of the dumpster's corners in a secure manner and in a manner that does not disrupt traffic if on the street or right-of-way; and
(3) 
Two reflective traffic cones must be placed in the front of the dumpster, along with two reflective traffic cones placed in the rear of the dumpster, to provide for visibility of its location during dusk to daylight hours; and
(4) 
Each dumpster must have the owner of the dumpster, along with the owner's address or phone number, visible on its exterior. If a permit holder leases the dumpster from a third party, the third party's name, address, and phone number must be visible on the exterior.
C. 
Each permit issued shall be for a term not to exceed 60 days from the date of the permit's issuance. The permit holder must adhere to all of the above-enumerated terms during the term of the permit. Additionally, before the expiration of the permit, the permit holder may provide written notice to the Township's Police Department of a request to extend the permit for an additional 30 days. The extension shall be granted as long as the permit holder has adhered to all terms of the permit during the initial term. Under no circumstance shall the permit term, including the extension, exceed 90 days in total.
One such permit shall be obtained for each dumpster to be placed on any public street or right-of-way. A fee shall be collected by Mahoning Township Police Department for each such permit issued, in an amount to be established, from time to time, by resolution of the Mahoning Township Board of Supervisors.
The permits required hereunder shall be in the form of a sticker or other device capable of being affixed to the dumpster for which the permit is issued, and the permit shall be so affixed to the dumpster by the permittee in accordance with the instructions of the Police Department pertaining thereto.
The permits issued pursuant to this chapter shall be nontransferable and may be used only by the permittee to whom originally issued, for the dumpster and at the location for which originally issued.
No permit shall be issued and no dumpster shall be placed on a street or other public right-of-way if, in the opinion of the Police Department, a dumpster could be placed on the property of the person requesting the permit in such a way as to make it accessible for removal.
Failure to obtain a permit in advance of placing a dumpster on a street or other public right-of-way shall be a summary offense, subject to a fine in an amount to be established, from time to time, by resolution of the Mahoning Township Board of Supervisors.
