The provisions of this article shall extend to all applicants and/or appointees to current and future agencies, boards, commissions and committees of the Municipality of Murrysville, except as may be otherwise provided for herein, whether such positions are filled by action of the Murrysville Council or the Mayor, including all advisory committees such as the Environmental Advisory Council, Murrysville Trails Committee, etc. and also all single-purpose committees such as the Marcellus Well Task Force.
Nothing contained in this article shall be deemed to alter, modify or supersede, in any manner, the provisions of the Public Official and Employees Act, and the jurisdictional authority of the Pennsylvania Ethics Commission, including the filing requirements thereunder for a Statement of Financial Interest, by their controlling due dates. All such state requirements remain in full force and effect on and after enactment of this article. If a Statement of Financial Interest is required under state law for a municipal office, an applicant or appointee for same shall timely comply with such requirement.
A. 
Without limiting the jurisdictional authority of the Commonwealth or of the State Ethics Commission, or the requirement for a municipal official to fully comply with the requirements of the Public Official and Employees Act, the Murrysville Council herein further declares municipal elected and appointed officials to any of the following positions shall be required to file a state ethics form after their election or appointment to office: Council, Mayor, Solicitors (Municipal and Zoning Hearing Board), Chief Administrator, Zoning Hearing Board, Franklin Township Municipal Sanitary Authority, Library Board, Pension Committee, Planning Commission, Finance Committee, and Uniform Construction Code Board of Appeals, as well as the Director of Community Development, Director of Engineering (or Engineering Consultant), Director of Finance and Taxation, Director of Public Works and Parks, Director of Recreation, Building Inspector/Senior Code Enforcement Officer, Building Inspector/Code Enforcement Officer, Police Chief, and Police Captain.
B. 
If it should be determined by the Pa. Ethics Commission or a court of competent jurisdiction that any of the above mentioned municipal officials are not obligated to file a state ethics form with the Commonwealth, such individual(s) shall instead submit said state ethics form with the Murrysville Chief Administrator on or before the controlling state deadline date as an independent requirement of this article. Such individual(s) shall be subject to all Murrysville Code of Ethics provisions.
All applicants and/or appointees to positions on agencies, boards, commissions and committees in the Municipality of Murrysville shall acknowledge and agree to follow the provision of the Murrysville Code of Ethics included herein at Exhibit A,[1] and as may be amended from time to time.

All applicants and/or appointees to positions on agencies, boards, commissions and committees in the Municipality of Murrysville shall complete, sign and file the volunteer's application for appointment form, as prepared or approved by the Chief Administrator, pertaining to the various agencies, boards, commissions and committees of the Municipality of Murrysville, as currently or hereafter established, from time to time. The form shall contain the applicant's acknowledgment and affirmation to follow the provisions of the Murrysville Code of Ethics.
A. 
The Chief Administrator shall prepare and maintain the volunteer's application for appointment form, with input from the administrative staff, and the various agencies, boards, commissions and committees, as pertaining, and also from the Council of the Municipality of Murrysville from time to time. A model form is included herein at Exhibit B.[1]

B. 
The applicant's acknowledgment and affirmation as contained on the model form shall not be altered without the prior affirmative approval by the Murrysville Council in a public meeting as an amendment of this article.
All of the following elected or appointed public officials, and all of the appointees to the following positions on agencies, boards, commissions and committees in the Municipality of Murrysville, shall take and sign an oath of office before commencing their official duties: Mayor, Council, Zoning Hearing Board, Franklin Township Municipal Sanitary Authority, Library Board, Pension Committee, Finance Committee, Personnel Board, Planning Commission, and Uniform Construction Code Board of Appeals. The oath of office requirement shall further extend to the Chief Administrator and all Department Directors as provided for in Murrysville Code § 3-62. The oath of office shall include an affirmation that the taker of the oath shall subscribe to the Murrysville Code of Ethics.
An applicant and/or appointee shall timely submit a completed and duly executed volunteer application for appointment form prior to Council's consideration of their request for appointment to a position on an agency, board, commission or committee. If a timely submission is delayed for any reason, an appointee shall promptly file same before commencing their official duties.
An appointee who fails to submit a volunteer's application for appointment form duly completed and executed for a position on an agency, board, commission or committee shall be subject to removal or recision of their appointment, upon written notice thereof, by the Municipality of Murrysville Chief Administrator. The removal action shall be effective 30 days after the mail date of the Chief Administrator's written notice to said appointee of and the appointee's failure to correct the said lapse in submitting a required form. The removal action may be appealed to the Council of the Municipality of Murrysville within 30 days from the effective date of said removal. An appeal shall contain the factual and/or legal grounds as to why the removal action should be rescinded by the Murrysville Council.
This article shall be applied prospectively to all applicants and appointees for a position on agencies, boards, commissions and committees of the Municipality of Murrysville, commencing with the date of enactment of this article.
