There is hereby created a Park and Recreation Board for the Township of Londonderry.

The Board shall be composed of seven members, who shall be appointed by the Londonderry Township Board of Supervisors.

The term of office shall be for five years and until their successors are appointed, except that of the members first appointed; one shall be appointed for a term to expire in one year; one shall be appointed for a term to expire in two years, one shall be appointed for a term to expire in three years, and one shall be appointed for a term to expire in four years, and one shall be appointed for a term to expire in five years. Thereafter, all appointments to unexpired terms shall be for the remaining time period left in the full five-year term in which the vacancy occurred. Vacancies shall be filled in the same manner as the original appointment and for the unexpired term.

The Board shall have the power to provide, conduct, operate, equip and maintain public park and recreation areas, facilities and centers subject to the provisions of this Part and the Second Class Township Code, and any amendments or supplements thereto, and subject to the budget appropriations made by the Board of Supervisors for the Park and Recreation Board.

Members shall serve without pay.

The Park and Recreation Board shall have the power to adopt rules and regulations for the conduct of all business within its jurisdiction; it shall appoint from its membership a chairman and such other officers as it may deem necessary for the orderly procedure of its business; and it may adopt by-laws, rules and regulations covering its procedure not inconsistent with the provisions of the state laws. The Park and Recreation Board shall, from time to time, make rules and regulations governing the operation and conduct of the recreational facilities operated by the Board, which rules and regulations shall become effective only after adoption by resolution of the Londonderry Township Board of Supervisors. Such rules and regulations shall become and shall be construed as part of this Part. The Board shall hold regular meetings at such time and place as it may designate.

The Park and Recreation Board shall maintain, operate, and supervise the public parks, playfields and all outdoor and indoor recreation areas and facilities owned or controlled by the Township of Londonderry as directed by the Township Supervisors by resolution.

The Sunset Golf Course, its facilities, employees, activities, management, operation, supervision and maintenance is specifically excepted from this Part and the authority of the Park and Recreation Board. The Board of Supervisors of Londonderry Township shall have all powers relative to the Sunset Golf Course vested in them.

The Park and Recreation Board may accept any grant, gift, bequest; or donation of services, equipment, real estate or money from any individual or group, to be used as specified by the donor, or by the terms of acceptance. The Board shall have no authority to enter into any contract or incur any obligation binding upon the Township of Londonderry, other than current obligations or contracts to be fully executed within the then current fiscal year, and all within the budget appropriations made by the Board of Supervisors.

The Park and Recreation Board shall have the power to appoint an executive director or superintendent of recreation, who possesses the necessary qualifications and who has demonstrated by actual work his ability to organize and direct a community recreation system, and such other personnel as may be deemed necessary and are recommended by the executive director, such positions and salaries to be approved by the Londonderry Township Board of Supervisors out of the Park and Recreation budget.

Funds appropriated by the Board of Supervisors, and budgeted to the Park and Recreation Board, shall be disbursed by the fiscal disbursing officer of the Township of Londonderry, upon vouchers issued by the Park and Recreation Board and within the budget appropriations made. Funds received by the Board from sources other than budget appropriations shall be deposited by the Londonderry Township Treasurer to the credit and for the use of said Park and Recreation Board, and disbursed as the above budget funds are disbursed, except that funds received by gift, bequest or otherwise shall be disbursed in accordance with the terms of the acceptance thereof.

The Park and Recreation Board shall make full and complete reports to the Board of Supervisors at least annually and at such other times as may be designated or requested by the Board of Supervisors. Said reports shall include an analysis of the community recreation areas, facilities and leadership, with particular reference to the extent and adequacy of the program, and its effectiveness in view of the public expenditure involved and the public needs to be met. The fiscal year of said Park and Recreation Board shall conform to that of the Board of Supervisors.

Such powers that are now or may hereafter be provided by statute of the Commonwealth of Pennsylvania, or by ordinances of the Township of Londonderry relating to the development and operation of recreation systems, public parks, and playgrounds, are hereby vested in the Park and Recreation Board, to be exercised by it subject to any and all restrictions contained in such statutes and ordinances.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fines and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.
