Any person, firm, co-partnership or corporation shall be prohibited from burning any combustible animal or vegetable matter, including papers or rubbish, within the Township of Londonderry between the period from 30 minutes before sunset in the evening and 30 minutes after sunrise in the morning, except a fire set and maintained in a container.

During the period from 30 minutes after sunrise in the morning to 30 minutes before sunset in the evening, it shall be lawful to burn any combustible animal or vegetable matter outside of containers. Except where the fire is in a metal container, it shall be unlawful for any person, firm, co-partnership or corporation to burn any combustible animal or vegetable matter without having a person attending said fire at all times while said fire is burning.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fines and costs, to a term or imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.
