The purpose and intent of this chapter shall be to preserve
the public peace and good order in the Town of Tonawanda and to contribute
to the public welfare and the preservation and protection of the property
and the person of the inhabitants of the Town of Tonawanda by declaring
and enforcing certain regulations and restrictions of the activities
of cats and owners of cats within the Town of Tonawanda.
This chapter shall be applicable in the area of the Town of
Tonawanda, New York, outside the Village of Kenmore.
As used in this chapter, the following terms shall have the
meanings indicated:
Any cat six months of age or older.
Both male and female cats.
Shall include, but not be limited to, permitting or allowing
a cat to damage public or private property of a person other than
the owner.
Any person owning, harboring, keeping or having the custody
or control of any cat.
A.
The owner of every cat shall be responsible for maintaining such
animal in safe, sanitary and healthful surroundings and in such a
manner as will not constitute a nuisance to neighboring property owners
or to the public, including the existence of noxious odors, unsightly
litter, or repeated or habitual violations of other provisions of
this chapter shall be deemed to constitute such a nuisance.
B.
No owner or other person harboring, keeping or maintaining any cat
shall permit such cat, while in the Town of Tonawanda, to cause damage
or destruction to property, or commit a nuisance upon a public area,
or the premises of a person other than the owner or other person having
custody or control of such cat.
C.
It shall be unlawful for any owner of a female cat to permit such
female cat to run at large when in heat, and such animal shall be
confined to the owner's premises during such period.
The enforcement of this chapter shall be done by the animal
control officer or other person authorized by the Town Board to enforce
the provisions of this chapter.
A.
Any person convicted of a violation of this chapter shall be deemed
to have committed a violation and shall be subject to a fine of $75
for a first violation and $150 for any subsequent violation within
three years.
B.
Any person taking part in or assisting in any violation of this chapter
shall also be subject to the penalties herein.
C.
Each day that a violation of this chapter is committed or is permitted
to exist shall constitute a separate offense.
