A. 
The Legislature hereby finds and determines that the pattern of each nonprofit contract agency purchasing office and program supplies, materials and equipment on its own may be costly and inefficient. New York State permits charitable organizations located in Nassau and Suffolk Counties to make purchases from commodity contracts awarded by the State Office of General Services, Standards and Purchase Group.
B. 
Therefore, the purpose of this article is to permit the County to make its commodity contracts available for use by nonprofit agencies.
As used in this article, the following terms shall have the meanings indicated:
CHARITABLE ORGANIZATION
Includes and is limited to a domestic corporation incorporated pursuant to the Not-For-Profit Corporation Law, constituting a charitable organization registered with the Secretary of State and receiving total revenue and support of at least $10,000 and which shall not be an exempted organization, and which renders health, welfare or recreational services.
FEDERATION OF CHARITABLE ORGANIZATIONS
Includes and is limited to a domestic corporation incorporated pursuant to the Not-For-Profit Corporation Law, formed by and consisting of not less than three charitable organizations, as previously defined, and performing joint and combined solicitation of charitable contributions by and distribution of the proceeds thereof to such member of constituent organizations.
A. 
Any charitable organization or federation of charitable organizations, as defined in § 189-2, which has entered into a contractual agreement with or is funded in whole or in part by Suffolk County to provide service to County residents is authorized to make purchases pursuant to the terms of contracts let by the Department of Public Works, Purchasing Division.

B. 
All purchases shall be in accordance with the rules governing participation by political subdivisions and other entities authorized by law.
C. 
All purchases shall be made in accordance with the contracts' terms and clauses.
D. 
Any contract agency electing to purchase commodities through contracts let by the Suffolk County Department of Public Works, Purchasing Division, shall be responsible for all payments due vendors for such purchases.

E. 
A contracted vendor is not required to conduct business with a contract agency as part of his/her County contract stipulations. It is the contracted vendor's discretion as to which contract agencies, if any, he/she wishes to conduct business with.
F. 
Participation by contract agencies in purchasing off of County contracts is subject to availability of the commodities.
G. 
Upon request, each charitable organization or federation of charitable organizations must furnish the County with information on the number of contracts utilized along with resultant savings.
